Plus for the unmarried folk? Shouldn't this waiting period then be applied to all US citizens wanting to marry?

Exactly! I complain about this process to my family and friends and when some of them bring up the topic of 'testing commitment' I ask why their own marriages were not tested first? What makes 2 US citizens a better fit than a US citizen and someone from another country? What difference does it make where my future spouse is from? Don't get me wrong, I can understand a slight delay for background checks and scans for visa fraud but the current process is absolutely unreasonable in scope and timeframe.

No one doubts your intention to marry your fiancee. US government however sees fake marriages, engagements all the time. They doubt the intention of the alien fiancee. Unfortunately with an engagement their is no written or documentary proof of its validity. So how can it be evaluated if the engagement is real or not. Honest and good folks are lumped with with the same. I dont see how 3 mths waiting period is too long. Even colleges take months before they decide on an applicant. Jobs offers take a couple of weeks. More applicants then enough people to handle the task. so the extended waits.

The divorce rate in the United States is 50%. You don't think someone could fraudulently get married, wait for the greencard and file for divorce? Happens every day.

On engagement: Of course one can provide proof of a long standing relationship.

Nice!! Comparing the wait to be with the one you love, with a job offer or a college admission? Brilliant.

Three months????? By that standard, my fiance would have been here last May and we would be getting married tomorrow. However, we are still circling in a holding pattern while the wheels of bureacracy grind on, six months after the K-1 petition was first submitted and has been back and forth across the Atlantic, Europe, and the USA now, kind of like a game of "hot potato". In the overall scheme of things, the number of K-1 petitions is pretty miniscule, so I think we just don't get much respect, allocation of resources, etc. to get them processed in a timely manner. To put it another way, we are LOW PRIORITY to the US govt. They have bigger fish to fry, wars to fight, illegal immigration problems to solve, etc. I think the notion that there are gazillions of bogus marriages out there is a trumped up excuse to relegate the K-1 petitions to the bottom of USCIS's to-do list (remember, USCIS is an agency that is controlled by the ever competent :no: DHS) .

3/31/06 - NOA 2

4/12/06 - NVC sent approved petition to Paris embassy

4/24/06 - fiance received instruction pkt (pkt 3)

5/05/06 - pkt 3 checklist returned to embassy

6/21/06 - 1-797s (2) received, petition "received", "reopened" by CSC

6/26/06 - email, RFE sent

Huh? Just because someone has a marriage certificate, that validates the relationship? BS.

Marriage certificate does validate the relationship. Everyone understands that. Even gays know it and so are fighting for it. It leads to joint ownership, survivorship benefits etc. Besides in all documents they always ask about previous marriages and divorces. Ever been asked of listing previous engagments in any forms.

Exactly the reason for the long wait times, background checks, interviews in the AOS process etc to ensure that the marriages are not fake.

Really? Do you think none of us have jobs or committments in the US and we have unlimited bank accounts therefore we can simply fly to our fiance's country?

The wait is not because USCIS is trying to ensure that we take care of them or to check backgrounds. Where on earth did you come up with this logic? The wait is due to the sheer incompetence of USCIS and their implementation of IMBRA. If you filed before March, the average wait time in Nebraska was 60 days. The average wait time in Vermont was 30 days. That proves the wait we are now experiencing (not 3 months my friend, we are at 5+ with no end in site not to mention the additional 6-9 months we face at the consulate in Mexico) has zero to do with the work they are doing and 100% to do with their ineptitude.

It is very easy for us to go and visit our beloved ones during this process but it's very heartbreaking to leave them (at least that's how I feel). I just don’t buy into the length of time it takes to complete the process in the name of “National Security.” On a side note, I wonder what the divorce rate is for USCs who marry foreign nationals. If the rate is significantly lower, maybe the government show impose some type of delayed gratification when USCs want to get married, and impose that in the name of "Family Values." I'm just venting because I want and need her here with me ASAP.

Not so. As Kitkat said, I do not have the money, time off work, etc to go see my fiance. I just paid $1100 to go see him last week. And it had been along 5 months since seeing him.

devilette - I agree! What I meant is that we are afforded the liberty to visit our loved ones. However, having the means is an entirely different story. Trust me! I understand because it cost about the same for me to fly (and that does not include the other expenses). I feel like ok... I’m American… I chose a mate... let's matriculate her so we can be together…. Why is that so difficult and takes so long????

The suspense is killing us slowly. Our physical package case has been at the Manila Embassy since 08Aug06 and we must wait at least another week or two more for them to issue us an interview date.

What I would really like to know is this, why is it that a company or corporation can pay $1,000 to have a workers visa rushed through while the K1 and K3 visa's get pushed aside?

I have no proof of this, but my guess is that even when a corporation pays for an expedited work visa, it doesn't really get expedited (after all, how would the company know what timing is "normal" and what timing constitutes "expedited"). Unless work visas are handled by a service center on fantasy island, it seems very unlikely that they have the staff or the competence to actually expedite anything.

Actually for the expedited work visas that the company pays 1000 for, I believe I read USCIS guarantees to adjudicate the petition in 15 days

Premium Processing Service provides faster processing of certain employment-based petitions and applications. Specifically, USCIS provides 15 calendar day processing to those who choose to use this service or USCIS will refund the Premium Processing fee and the relating case will continue to receive faster processing.

The processing period that is used to determine whether or not USCIS meets the 15 calendar day period will begin when the current version of Form I-907 is received by USCIS at the correct filing address noted on the form. Within the 15 day calendar period USCIS will issue an approval notice, or where appropriate, a notice of intent to deny, a request for evidence or open an investigation for fraud or misrepresentation. If the notice requires the submission of additional evidence or of a response to intent to deny, a new 15 calendar day period will begin upon the delivery to USCIS of a complete response to the request for evidence or notice of intent to deny.
