hey guys.. any approvals yet? god.. i didn't check the uscis site in 3 days.. didn't know if i got approve or not..now the server is down Server is currently unavailable or down for maintenance..hopefully everyone will get their noa2 in 2-3 weeks .. (finger's crossed):help:

02/07/2011 - NOA2 approved! 201 days since NOA1!!!

I went to see tax professional and H & R block to ask issues about "Filing Status". They recommend to file as a "filing single". When she comes to USA, then file amendment for tax return. I have read people planning to apply for ITIN number. A person has to be presentin USA to apply for ITIN. Besides, it can take upto 6 weeks as the IRS has to go through different documnentation like different types of identification. Thus the best bet would be filing as single and then file amendment when the spouse gets in USA.

It's much more financially beneficial to file as married jointly. A person does not have to be present in the USA to get a ITIN number. We have just filed our taxes, and we used Turbo Tax 2010.

You cannot e-file by doing it this way. The US citizen has to print out the 1040 tax return, and then attach the foreign spouses W7 ITIN application (downloaded from the IRS). The foreign spouse needs to sign this, and the whole lot has to be submitted to the IRS in Austin, Texas. Full instructions are on the IRS website. A notarized passport is the only ID required from the foreign spouse.

It is beneficial to the tune of around $3,000 I believe.

You were given bad advice from the tax professional, but they DID get the 6 weeks wait right!

when you go to HR block talk to someone who is a Senior person, not everyone at HR block has same knowledge so first get the persons tax experience (I say 10 years is good but 15 years is even good) and go talk to him/her.

Thanks for the follow-up. I find it odd that you'd receive an email from the USCIS without a sender's name, but I guess it is what it is.

Regardless, I'm hoping for a bunch of approvals this week :thumbs:

This is what my lawyer recently sent me after i complained about how the Transfered cases are almost being forgotten.

Shawn, The notion of filing a mandamus court action is likely not viable at this time. Cases are moved systematically. If one group of cases is taking longer than another group, this is not a USCIS concern, or a court concern for that matter. For those of us who have been working with the USCIS for years it becomes apparent that individuals come second. From a government standpoint, what is important is how to function as a bureaucracy. The more visceral the consumer becomes, the less willing are government agents willing to help. Your focus should be on whether your particular case is tracking outside your group.

I have found that protests do work. If you can get a bunch of people outside a service center with signs and get the media involved, you can receive attention and get results for the group. Government officers respond to public pressure. I hope this helps.
