Good day everyone! I wanted to ask what are the requirements needed to petition my children and wife. I'm an LPR, newly wed. I went here in the United states last year, then after few months i went back to the philippines. I stayed in the Philippines for 10 months, and now I'm here in US again. I just wanted to know what are the requirements needed to file for my children and spouse petition and how long it will take for them to reside here in America.

For you Children..

You will Neeed Original/Certified Birth Certificate to prove relationship... the documents should also have your name on it and mother.

Spouse you will need Marriage Certificate for both of you.

IF either of you were previously married... show divorce records.

1 Passport size photo of you

1 Passport size photo oh her

1 completed and signed Form G-325A for you

1 ompleted and signed Form G-325A for her

other documents showing relationship bond example -

- Birth certificate of childen born to both of you.

- Financial Bond etc

Your Visa category will be F2A.. for the PHILIPPINES the nvc visa bulletin is saying 01JUN10 (good thing). The trends have been great.... if the trend continues your wife and children would be in the USA sometime between 9-12 months.

Oct 29 2012 - Pkg Delivered
Dec 24 2012 - Case Complete

May 17 2013 - Interview-Approved

July 19 2013 - Enter the USA

For you Children..

The above is a good answer but not a substitute for carefully studying the I-130 instructions and the guides here.

K3 is a dead category that never applied to the family of an LPR. Follow the IR1/CR1 guide as the requirements are the same even though the visa category is technically different.

Be aware that as to your own eligibility for citizenship later, the 10 month absence from the USA will impact your eligibility date.

Facts are cheap...knowing how to use them is precious...

yup, as long as you don't get 'out of status' because you stayed outside of USA for too long.
