Hello everyone,

I just accepted a new job today and am already in Colombia for our interview on Tuesday. I was wondering what do I need to show the embassy for purposes of the I-134?

I had planned on filing mine (as the primary sponsor) as unemployed, but using my assets (which are now borderline because I've been using the money in the bank to live on) and having a co-sponsor ready to go, if necessary. Now, with the new job that will start upon my return to the US a week after our interview, with pay several times more than the 125% poverty guideline requirements, what do I need to show them in order to not use the co-sponsor? I won't be back in the US before our interview and anything that they give me (offer letter, etc.) would have to be in electronic form at this time.

I am beyond ecstatic about landing the new job and our interview coming together at the same time, but this leaves me little time to pull it all together for the consulate and I need a two-minute drill style game plan.

Thanks for any ideas

I would have the job that offered you the job send you an electronic copy of the offer letter and maybe the start date and take that to the interview with you and I think you should be fine.

I sure hope that's enough. I'm doing everything I can to facilitate having that letter in my hand before Tuesday.

If I don't have it in time, is a I-134 denial permanent (meaning back to USCIS and we have to file a new petition) or will they just delay issue of the visa until the proof of income is submitted?

IMO Go prepared with the cosponsor and get the visa. Why add time with an RFE.

At the Adjustment of Status phase you will submit the I-864 affidavit of support. That is the binding one. As that's several months down the road you will be established in the new job and should not have a problem meeting the requirements.

I think I will do just that, only that I will change my current I-134 so that it doesn't say 'Unemployed' and 'Derive an income of $0' to the name of the new company and my new income level. Even if they don't accept what I am able to provide as evidence on that day, I think it looks better than the original I-134 and it is the truth, after all. Then, if my original assets-based case doesn't cut it, I still have the co-sponsor (and an alternate in case of any unforeseen technicality) in place.

Anh is on the right track. Get the job offer letter (contract if applicable) but the co-sponsor is invaluable. IMO, if you are even "just at" the 125% level then you are good to go and I would not lose a moments sleep. Finances are important, but a genuine relationship is more important. Good luck and happy travels. I hope to be receiving news tomorrow that my wife's interview date has been set for November.
