K-1 Interview - Proof of Divorce

In reading the documents requirements that was downloaded from the US Embassy in Manila I noted the following statement:

"PROOF OF TERMINATION OF A PRIOR MARRIAGE. If applicable, official documents (divorce decree, annulment decree or death certificate, etc.) that prove all prior marriages contracted by you and the petitioner have been legally terminated prior to the filing of the petition must be submitted."

My fiancée has never been married, and will provide a CENOMAR. I have been married twice before, and included my most recent divorce decree with my I-129F. I do not have a copy of my divorce decree from my first marriage over thirty years ago. Is this a reason for an RFE? Will copies of both divorce decrees need to be presented for the interview at the embassy or will the most recent one suffice?

If I were you I would try and get all divorce decrees to include...Good luck

You should be able to request for a copy at the county office, with a seal. Proof of both divorces should be in your fiancee's hand during her interview...especially if you mentioned both divorces on the I-129F.

You need both for the I-129f and the interview at the consulate. The court where you were divorced has a copy. If you know where that was (state and county) it should be no trouble to get. It is a public record and can be sent to anyone that asks for it, usually for a small fee.

You have actually provided the answer to your own question. Definitely obtain your divorce decree from your first marriage and submit it to your fiancee before the interview (that is if you are not planning to attend the interview, in which case you should take all potential evidence with you to the interview).

My first marriage ended in 1970 in a State I have not lived in since 1971. All that was needed - in 2009 when I filed - was a telephone call, a letter, a check and a self addressed envelope and presto, in days I had the document. So long as you know the county and state where the divorce was granted, regardless of the years involved, you can get your documents and YES you must present them.
