Removal of conditions..and time of application

Hi all,

Hope my fellow green card receivers and all VJers are doing good. If you see my history I got my conditional green card on July 31st,2009 based on marriage from B1/B2. Now my card expires on 07/11/2011. Here are my queries below :

a) Ideally when should I apply ? It says 90 days before GC expiry. Should it be April ?

b) Here is a list of evidences that we are getting together :

1)Joint Bank accounts

2) Joint Tax Returns

3) Company online salary account profile showing us husband and wife

4) Joint Ownership of property ( we are stating we cannot as my wife would be decalring bankruptcy and her bad credit may affect me )

5)Joint car insurance

6) Joint Credit cards ( we are stating we cannot as my wife would be decalring bankruptcy and her bad credit may affect me )

7) Common address in photo ids

8) Common utility bills ( electricity, water and trash )

9) Joint AAA membership

10) Joint stock holdilting

11) Common Phone bills

12) Joint cable bill

13) We have a small business together

14) Joint membership in cultural organisation

15) Joint Dog registration

16) Joint car ownership

17) Hotel receipts and pics of honeymoon.

Other secondary evidences like lots of photos and testimonials from her daughter and friends.

Does this look like enough? Do we need to add something. We thought of the retirement fund, but she is under state teacher`s disablity...and it somehow do not allow beneficiaries.

All help would be appreciated.

You have plenty of documents, make sure that the important ones like the tax returns, bank statements, salary certs. property & business ownership and any joint financial documents are arranged at the top of the list. The dog stuff can go to the bottom of the list.

You are yet to file for ROC in 2011, make sure you also collect the latest 2010 tax returns copies or Transcripts and financial documents etc at the time of filing.

Since your 90-day time window starts approximately 04/11/2011, file approximately about 1-week after 04/11/2011.

According to USCIS, you are supposed to apply within 90 days of the expiration of the GC. 90 days is 3 months. If your card expires 7/11, they will accept your I-751 anytime between Apr 11th (day 90) and July 11th (day 0). You may want to mail it closer to day 90 than day 0, even though you could send it 2 weeks before the expiration date and you'd probably be fine. I would not mail it before April 11th though. Unlike some people here have posted, nowhere on USCIS does it say it has to be 90 days on the dot like a few people on this forum have posted. That's ridiculous.

If your card expires 07/11/2001 the 90 day window will open on April 12, 2011. It is 90 days, not 3 months. They will return your application if it is even a day early!
