Mom has a visa - ok

but

if mom is not in USA, then only need to file I-130 for IR-5 visa, she'll interview in her 'home country'.

if mom is in USA, then it might be possible to file an 'AOS' case , instead.

Follow this guide - http://www.visajourney.com/content/i130guide2

but where it reads 'spouse' substitute 'Mother'

and

no marriage certificate between you two required.

*** moving to AOS/tourist forum ***
