In filing the adjustment of status, do we have to fill-out a separate I-485 and G-325A form for my 14 and 11 year old children? If so, do they

have to sign the forms or should i sign it since they are minor and i am their mother? Also, can my children submit an I-765, Employment Authorization? We plan to use it in applying their ssn because our I-94 was already expired.

I'm really not sure, but I could direct you to avvo.com. You can ask attorneys questions for free.. and they're very helpful! They're usually pretty fast about replying, too. Some of them will just tell you that you need to consult a lawyer but most of them are nice enough to just answer your question :)

I'm assuming you're a K1 and the kids are K2's...

Yes, a separate complete AOS package for each of them, including I-485 and G-325A. Read all of the form instructions carefully. Some things do not have to be submitted multiple times if you are filing their AOS package at the same time as yours. For example, each of them will need an I-864 signed by the US citizen sponsor, but they don't need the accompanying financial evidence (tax transcripts, etc.) if that is included with the I-864 for the primary applicant. Also, the fee is substantially lower for the 11 year old if filed at the same time as the primary applicant.

If they are capable of signing their own name then they should sign the forms. You can sign as the person who prepared the forms. That's what I did with my step-kids.

K2's wouldn't have been eligible for SSN's even if their I-94's weren't expired. Only a K1 is eligible for an SSN. You can include the I-765. There's a reasonable chance they'll get the EAD just before or even after they get the green card. Unless there's an urgent need for them to have an SSN then you could just wait until they have a green card.

Yes, each child needs separate I-485 and I-765 forms; the children either need an approved EAD or a green card to apply for a SSN. Only your 14 year old needs a G-325A; children below 14 years old don't need a G-325A on their I-1485 application.

You may sign for them on their forms; write this in the space provided and then sign on top of it: <Your Name> Mother of Minor <Your Child's Name>

Thank you for all the replies. Are you sure we need a separate I-864 Afidavit of Support for each child? If so, what would I put under Part 2 (Principal Immigrant) and what would I put under Part 3? It seems all three would be exactly identical. Really seems like only 1 I-864 would be needed.

Well...like in our case, my daughter and I filed for adjustment of status concurrently, so I needed a signed I-864 with supporting documents. On my daughter's I-485, she only needed a photocopy of the I-864, no supporting documents needed.

Are the children filing concurrently with you? Or did you adjust status ahead of them and now they are filing after you did?

Yes, they are filing concurrently with me. Thank you so much for your help. Seems like they only need a photocopy of my I-864 and their I-485. No supporting documents needed for them.
