I just had my interview visa today and the embassy told me i need to have an I-212 approved before i can get my visa. She said everything else was fine and after i got the Approval for I-212 i could get my visa.

Any idea on how long it might take to get the approval noticed for I-212?

Thanks

I think you have to start with finding out why you need a I212, and where it needs to be filed first. What code did they write on the denial? In other words why did you need the I212?

Please contact an attorney. What age were you when you left. . .if it was before you turned 18 and six months (exactly) then you won't need a 601 which would usually be required in this case. . .but if they're telling you to file a 212, then they are saying you were deported. . .if you were not, then you need to try to prove that in your 212 package.

I left the states 2 weeks before i turned 18. I thought i didnt have to file this form since i left underage but the councel at the embassy told me i had to have form I-212 approved in order for me to get my visa. My lawyer will be sending this form out on Monday. However, I would like to know how long is the waiting time to get your I-212 approved?

I think the I212 is for deported or excluded. The way to find processing times on this is to find out if they process at the USCIS sub-office with jurisdiction over your country, which in this case I think they do .. and then to find other folks who are processing I212 or I601 at the same post and see what kind of turn-around times they have.

What post are you turning the I212 in at?

The I-212 is a permision to re-enter the U.S. after being deported. Since you were underage when your deportation occured, you are not required to file the I-601. I The I-212 has a processing time of approximately 1-year, but in some cases, like mine and Edward Torro's (another VJ member) you can get it within a couple months. It really depends on the office that's handling the case.

Good luck
