Hi,

Can anyone tell us what we have to do after we got married.

Who do we have to inform ?

and what happens to our 90 day visa?

Does he/or she still have to leave the states on the day the border control has stamped in the passport?

any help or advise would be welcome.

You can apply for your SSN in your married name after you receive your marriage certifcate.

Your K1 visa is expired after you use it. Your I94 is good for 90 days. After that expires I'm not sure what your status is.

You should apply for adjustment of status as soon as possilbe as well.

And I'm not sure what you mean by "leave the states on the day the border control has stamped in the passport". If you mean do they have to leave when their I94 expires, then no.

Get married within 90 days of entering the US. After that, submit an AOS application as soon as you are able.

You're out of status when the I-94 expires, but that won't prevent you from adjusting status. Just don't leave the US until you get either advance parole or the green card.

The moment your spouse entered the US on a K1 visa, the visa expired (it's a single entry visa). You already married within the 90 days allowed on your spouse's I-94 (arrival/departure record), so what happens next is your spouse has to apply for Adjustment of Status.

You will find the checklist of requirements there. Once the application has been submitted and you receive the NOA1 (receipt notice), the spouse has to remain in the U.S. throughout processing.

If you are planning a trip outside the U.S. while the application is in process, then the spouse also needs to apply for Advanced Parole (AP); if your spouse exits the US without AP, re-entering the US will be a problem.

Aside from the Adjustment of Status, your spouse has to apply for a Employment Authorization Document (EAD) so s/he can work. Does your spouse have a social security number already?

Yes, I have a social security number already.

But my concern is after the marriage , if i DON'T file straight away for A.O.S what may happen then?

You have a social security number...but do you have work authorization? That's what the EAD is for...can't work without one until the green card comes out.

If you and your spouse are planning to visit family back in the home country, or if you guys are planning any kind of vacation outside the U.S., you cannot re-enter without Advanced Parole (AP).

Depending on which state you guys live, there are some other limitations...can't apply for a driver's license, can't get a bank account, can't become eligible for insurance, can't qualify for financial aid if you decide you want to go back to school...the list goes on.

It all depends on what you guys can live with...you can apply for adjustment of status anytime...and doing so not only protects your status in the U.S. but will open doors for more mobility.

Another update: If you wait too long, you will get hit with higher fees starting November 2010.

AOS Fee will go up from $930 to $985

Biometrics will go up from $80 to $85

So if you file your AOS+EAD+AP now, it's only $1,010

If you wait till November or later, it's $60 more.

EAD filed separately from AOS is $340 now but will be $380 in November.

AP filed separately from AOS is $305 now but will be $360 later.

Doesn't sound like much for one applicant, but if you consider the other members who are applying with kids, it'll be kinda painful (so glad we got ours in this month!)
