Your type of case REQUIRES an interview. It is absolutely mandatory, and you will have one. Don't let K-1 adjusters people confuse you; their process is different. (They were already interviewed once at their home country consulate before arriving here). And, contrary to the above poster's comment about military, if you file a concurrent 130-485 and your spouse is deployed, you would go to the interview alone. There were a few military non-K adjusters in April who went alone to their interviews. Anyway, the interview is a huge relief and sort of fun because you get to talk all about yourself! Don't sweat it! :)

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Actually I wasn't expecting to not get an interview. Like I said, I just find it INTERESTING that a lot of people don't have to and just wanted to know why! I have had a lot of family go through the same process that I'm going through and every single one of them had to go through an interview so that's why I was curious about it..

I'm not really sweating the interview, my marriage is 100% legit, I've been coming to the U.S. since I was 1 and overstayed when I was 11... met my husband when I was 15, and married just this year after we graduated and got our degrees. I just hope they don't give me a hard time because I was denied permanent residency before I even overstayed my visa because my step-dad backed out of being my sponsor. Our attorney told us not to worry about that though but I still feel a little iffy about it  ....

But thanks for all the responses! :D

  • 4 months later...

I got my permanent resident card / green card without an interview. It was just sent in the mail once the visa bulletin board became current with my priority date.

I came via tourist but a relative recommended me to a company who saw my credentials and wanted me to work for them. They sponsored me and my tourist visa changed to H1B.

After H1B, I had to be labor certified. Once the Dept of Labor certified me, my adjustment of status / I-130 and I-485 were then sent.

Got my green card in the mail last month without any interview.

I guess its on a case to case basis. Most approval of AOS applications via employer petitions that I know of did not have to go thru an interview and the GCs were all received in the mail like mine.

GCs via marraige are usually 100% sure of an interview before approvals.
