Affidavit of Support- Alternative Options

Here is the situation, I lived abroad from the ages of 18 to 22 (I'm 23 now). Thus there are no federal tax returns for me at all that show any income (as I was a student overseas and was not working). I moved back to the US in January, have been working since 2 weeks after I landed but until August I was not making the required amount of money to meet the 125% poverty line required.

Now, I have a sufficient income, but lack the federal tax returns as proof. And as I will not receive any federal tax return until January of 2012 to show my income, is there any other alternative methods of proving that I have the income to support my fiance? Or is the tax return absolutely required.

I'm sure it goes without saying that the thought of having to wait 2 years, plus the wait time of the visa processing fee, to be with my fiance is devastating in itself (let alone what the reality would be).

I'm sure this has probably been posted in a myriad of forms before me, but I can't seem to track down any stable thread that answers the question in full.

Thanks in advance, this has been bothering me for nearly a year now.

Ok, so here is my understanding of the situation:

The I-134 doesn't technically require you to have a copy of your most recent tax return. That requirement is actually tied to the I-864 which is a similar form but you file it during AOS rather than during K-1. They use the I-134 to pre-evaluate whether or not you would qualify under the I-864 requirements. Definitely you can also use a couple of other things as proof of income such as a few recent paystubs, a letter from your employer and a letter from your bank stating that you make a regular deposit of $X (your paycheck). I did a little bit of searching as well and someone else was recommended to write a letter stating that because they received no income for the years x - y they were not required to file a tax return, hence the lack of return. Hopefully someone else will come along who has done it before and can give you better advice. For now though, hopefully that helps. :star:

Edit: That advice is probably sound for when you go through AOS but I did a quick re-read of the I-134 instructions http://www.uscis.gov/files/form/i-134instr.pdf as well as the affidavit of support tips http://www.visajourney.com/content/support and I'm no longer convinced that a copy of your tax return is actually required.

If your current annualized (not year to date) salary/earnings is over the requirement that is good. You will document that with a letter from your employer (position, time there, pay rate) and recent paystubs.

Regarding no prior tax returns, simply write an affidavit (Statement) to that effect and submit it with the I-134. You will need this same affidavit at the Adjustment of Status phase. As of August, I'm making over the requirement (providing the requirement is still around 18.5k annually). But even if it's not, I'm still making over it. I've been reading around the site, and even in the 'to do' description list of affidavit of support documentation, it doesn't even list a tax reform requirement. So I'm really hoping.

I had to go through a similar process when I was 17 for a student visa into the UK and it ended with me having a permanent nervous disorder. So forgive me if I post a lot with a lot of my insecurities and paranoia. But thank you so much for the information!

This might be an incredibly stupid question, but just to clarify. I send the first couple of packets into a bureau somewhere in the US, depending on where I'm located. And they send those packets to the ljubljana bureau for his part of the process?

Tax returns do not prove current income and that is what they base it on. Show proof of current income such as employment letter, check stubs, etc. Attach a letter explaining why you have no tax returns. Sleep well.

You as petitoner need to submit a complete I-134 along with supporting documents. A co-sponsor would also do the same.

The I-864 is not used with a K1 petition. It would be used later during the Adjustment of Status.
