Hello all, I have come to this board seeking help for my dad. He recently lost his social security card and I took him to the ss office to get a replacement. However, I was denied because they claimed his i-94 was expired. My dad came to this country in 1994 as a indefinite parolee under the family reunification plan. Since then he has not applied for a green card and I just became aware of this. What do you guys recommend I do? Could his i-94 be expired and is there a method to get it renewed since he is a parolee?

If the I-94 is expired it won't be accepted. Why doesn't he have a green card yet? I'd get that ball rolling and then come back for a new SS card.

Sounds like he's overstayed and is illegally staying here now. I'd get a lawyer working ont.

Sounds like he's overstayed and is illegally staying here now. I'd get a lawyer working ont.

If he's a public interest parolee (Specter amendment, Cuban/Haitian, Southeast Asian, or other act) then his I-94 would not expire, but he'd still need to file an I-765 to be eligible for employment, and he'd need to file an I-485 to become a permanent resident. None of these acts were intended to allow someone to just hang out indefinitely in the United States without eventually leaving or seeking permanent residence.

If he's a humanitarian parolee then his I-94 expired one year after he entered, and he would never have been eligible to work.

His basis for being paroled determines whether SSA screwed up when the originally issued his SSN, or they're screwing up now by not giving him a replacement card.

Hi, guys thanks for the replies, didn't think this forum would be so helpful. He is public interest. I wasn't aware that his i-94 would expire since it said indefinite. Thanks for the help guys, I am working on getting him a green card.

I have a question for "JimVaPhuong" when you said "His basis for being paroled determines whether SSA screwed up when the originally issued his SSN, or they're screwing up now by not giving him a replacement card." does this mean that I could fight this and have them re-look at the i-94 because he is a "public interest parolee"?

His I-94 would not expire if he is a public interest parolee. It would only expire if he was a humanitarian or emergency parolee.

SSA is screwing up now. They issued him a Social Security number, which he was eligible to receive. There should be no issue now giving him a replacement card. A Social Security card is not authorization to work, and they shouldn't be treating it as if it was.

That said, you can kick and scream and try to get your local SSA bureaucrats to pull their heads out of their hineys and give him a replacement card, or you can just wait until he get's his EAD or green card. They will be a lot more cooperative after that.

BTW, I hope he hasn't been working in the US. Without an EAD, he was not authorized to work. Having a Social Security card would not have changed that. :blush:
