K1 DENIED!! What next!?

Wow, how heartbreaking! My wife and I met 15 months ago in China. Ten (yes,10!!) trips to China and 150,000 flown miles later, We found ourselves at the embassy in Guangxuopost-80216-096595500 1283049688_thumb.jpg for her interview. As you can imagine, we had hundreds of photos, receipts, etc. as evidence that our relationship was legitimate. We even had a wedding ceremony this past february in her hometown. I even lived with her last summer in Shenzhen.

The interviewer was incredibly RUDE and gave her less than 3 minutes of his time. He barely looked at a little of the mountain of evidence and denied her with a "blue" form. He told her that she needed phone records and that was all we were missing.

This sounds like total BS to me. Had he spent three minutes with both of us ( I was waiting downstairs! ) he would have easily seen that ours was a legitimate union. After talking to many people ( including her friends, all of whom were passed with barely a thought! ), we were told that maybe our age difference (she is 29, I am 48) was a factor in the denial. My greatest worry is that this man was not being truthful and has no intention of approving us. As you can see by the photo, neither one of us appears our age. Anybody have any thoughts/comments/suggestions would be greatly appreciated.

K1s are for fiancees, not wives.

Sounds like it wasn;t denied but more evidence was asked for, correct? Provide it and you should be fine.

you can use "prtscr" button on your keyboard to capture the screen then paste it on a doc or any picture editting software.

Phone records seems like an outrageous reason for not getting approved. So many people use video chats these days, and with cost of long distance, skype is the best option. Perhaps next time you will get a nicer officer. Best of luck!!

I am curious about phone records for the interview. Yes, I do call her all the time, but she never calls me. Way to expensive. My phone bill will show that I have repeatedly called a number in the Philippines but how do we prove that is her cell phone. She can't take her phone to the interview. Very curious about this.

she is not denied then if they told her to submit the blue form.ask her if what was indicated in the blue form they gave her.because taht form is still usefull ones u will return back to the embassy.if the missing evedence is ur phone bills,you have to provide it then.my evidences that i brought with me was tel.bills,pictures with him and my family.the embassy might need to see that u having much connections.if u dont have tel.bills,u can print out all ur chat records if u are chatting each other...that way she will be approved.please tell her to keep the blue form.she will need taht once you complied

...John,i just read ur journey.dont worry on the tel.records...send ur tel.records to her before her interview.request ur long distance records to your telephone company.that was we did,too.pictures,receipts,too.that all help her to be approve.goodluck and godbless.

Better advice than this has rarely been offered on VJ. A big +1 for this.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

sound like a bum deal.. sorry for you turn down but it doesn't sound like you been denied that they only want you to submit new evidence unless they told you you had to file for a waiver then most likely they will hold your case there at the embassy.. you have up to a year to submit new evidence to them for the counselor to review ..i would try to contact that embassy and see if there saying the case is still in review and what additional type evidence they want you to submit hope this helps hang in there.

we were denied too but in uscis level because we did not file the right way. we did not include our form 139 our pictures and proof and relationship, and other forms. after 2 months we REFILED and now we are waiting for our noa2...hope it will come soon!
