I received a 2 years GC in May 2010, and I want to fly back to China (with my baby) to visit my parents for 6 months which is from Jan 2011 to Jul 2011. Is it allowed? What is the longest time that you can stay overseas when you have your 2year GC?

Thanks!

A green card is valid for readmission to the United States after a trip abroad if you do not leave for longer than 1 year. If your trip will last longer than 1 year, a reentry permit is needed.

Thanks for your info!

So I assume 6months will be fine? Will it affect my application for a 10 year GC?

6 months will be fine.

Can it affect your 10 year card? If you do it every year - than it might be an issue - (how can you have a bona fide marriage if your constantly apart?). Strong evidence either way will always be in your best interest.

You will also want to keep track of all your trips (date/length) - for the timing of a USC application.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

We has a 9months old son now, and the reason of the trip is partly letting our son meet his Chinese grandparents who are my parents.

Can it be a good evidence?

U don't need any excuse/evidence if you're just going to be in china for 6 months.

I know. What I mean is having a son would approve that we are having a bona fide relationship?

Does 10year GC must have a interview with my husband together?

Yes, a child indeed will help much. When I had my interview to remove the conditions there was no interview involved, my brother who had the same process didn't go to an interview. you'll send the docs to remove the conditions and IF uscis feels the evidence isn't sufficient then an interview will be required. You can go to the interview alone. I had a cousin who went to her interview alone and took the child they had together and things went just fine. It is probably just better if your husband accompany you.

Yup ! Is some exception to this, but is very rare.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.
