For the Affidavit of Support I intend to just use just my salary as the only income to qualify the petition for support. In the I-864 document it requires that you submit a copy of last year's tax return (to indicate adjusted total gross income reported on the 1040EZ tax return form). However, I returned a 1040A instead of a 1040EZ. Does that matter? I still only plan to use my salary as the source of income in the petition. Thanks for your advice.

I dont think it matters. But why dont u just request your transcript as it is free and then you can send the tax return just as a FYI kind of thingy.

johndoe12 is correct. Get last 3 years IRS transcripts for free and submit to NVC along with other documents. You should get transcripts by mail in less than 2 weeks. If you are in emergency, IRS will even fax them to you.

I used turbotax, can't I just print the copys of my tax return that I e-filed that are stored online, wouldn't that suffice?

That's sufficient with your W2/1099, employment letter and current year paystubs.

But best documentation is IRS tax transcripts, employment letter and current year paystubs.

I have already acquired my 3 year tax transcripts and will be sending them in with my I-864. Do I still need to send the 2009 Tax Return and W2/1099 or is it not required when sending the transcripts?

I sent the transcripts too. I didn't want to file my taxes for '09 because I'd owe without being able to add Merlaine so I included the unsigned, completed 1040 and a letter explaining why I hadn't actually filed it yet, and '06, '07 and '08's transcripts.

no, it is an OR not an AND.... you send in transcripts OR actual returns...

If tax transcripts are provided, 1040 is not required. For current year, include employment letter, paystubs etc.

I have and I-864 question too! I just received my NOA1 and am getting prepped for the I-864. I actually am in the process of filing my 2007-2008 tax returns because I was living/working abroad full-time and was not aware I had to file in the US. Long story short, my income in 2007 and 2008 was less that $15,000 as I was a student back then. But in 2009 it was well above the 125% line and I can get an employer to type up a letter stating how much I make per year, plus I can print off all my paystubs.

Will they have a problem with the fact I made barely any money in 2007/2008? I am also worried my tax returns won't be processed by the time I need to send in all the info, then what? I won't have W-2's because I didn't work in the US, so all I will basically have are my canadian tax returns in which my income will match what I am filing with the USA. Am I over-thinking this?

You should state (also file 2007 and 2008 tax returns. For NOA2 and NVC, you have another 4 to 5 months time from now onwards unless any magic happens) you were student during that period and provide 2009 tax transcript, employment letter and paystubs. Then you should be all set.
