Require AOS related answers Please!

Timeline

Hello All! I am a newbie here in terms of posting, but I have browsed through the forums thoroughly, before shortlisting on my queries. I would look forward to some help and guidance from all the helpful people here.

My wife, who is an american citizen, is filing for my immigration tomorrow and I would like to double-check the forms and documents before she applies. Here is what I would have in the envelope:

-> Form i-130

-> Form i-131

-> Form G-325(a) (each for me and my wife)

-> Form i-485

-> Form i-693

-> Form i-765

-> Form i-864

We are also including a copy of both of our passports, her proof of citizenship of USA, a copy of our marriage certificate, passport sized photographs, a copy of my current B2 visitors visa and a copy of my i-94 card. I also have my birth certificate copy enclosed.

Now I would like to know if we have to put in more evidence of our marriage , like photographs of our marriage and/or previous photographs through our relationship. Also, do i need to include a copy of each and every page of my passport and the back of my i94 card? Do we put in all the forms in the same envelope and drop it at the drop-box in chicago?(That is where we live).

Importantly, in my case, do i need to get my medical examination done before filing for immigration? Lots of confusion here!

I would include one exhaustive cover letter that includes everything in the package. Is that correct?

A Final question - how long does it take these days for processing of EAD and AP? I know there is no fixed timeline, but what is the current trend in a case like mine where its sponsored by spouse.

I know these are a lot of questions, and all prompt replies will be highly appreciated. Thank you all!

Yes, you should include some of those, as well as any joint bills you have together.

Not each and every page - just the page with all the information on it. Yes, to the back of the I94 card.

Yes, all in the same envelope.

Yes, how are you including the 693 if you don't have the medical examination done? It must be done before you go by a qualified civil surgeon or you will get an RFE (request for evidence).

Yes, that's fine.

A Final question - how long does it take these days for processing of EAD and AP? I know there is no fixed timeline, but what is the current trend in a case like mine where its sponsored by spouse.

It varies a lot, somewhere between 2 & 3 months, I would say. Other people may have better guesses/estimates.

Married - 3/12/10

AOS Filed - 5/13/10

Biometrics received - 6/5/10

Biometrics done - 6/9/10

Touched - 6/7/10, 6/16/10, 6/17,10 (all)

That was an exhaustive reply, thank you so much for that! So, I would soon be taking up an appointment with a civil surgeon in my vicinity and get it done. Also, I would be getting my vaccination certificates from India. Is there a certain format for those vaccination certificates?

I went through one of the guides on this website where it says birth certificate for the intending immigrant is not required anymore. Can this be confirmed please? Thanks. Also, do we require to send in color copies of the passport?

There is no certain format for the vaccination certificate. Mine just had my doctor saying I got this and that in this year. You still need birth certificate. The copies don't have to be in color just regular.

There is no certain format for the vaccination certificate. Mine just had my doctor saying I got this and that in this year. You still need birth certificate. The copies don't have to be in color just regular.

Thanks for the reply! I have arranged for the vaccination report to be faxed to me like tonight itself! And also, I have already made an appointment with a surgeon for Monday. Hope everything goes out well. By the way, the doc is charging around $250 for the medical examination. Is that a fair price? Looks like it to me, but advice would be useful. :)

One thing I wanted to know is, once my wife has filed for my immigration and adjustment of status, how can the EAD be expedited? Does it also mean that the AP would be expedited too? How can that be done, and does it make the process any faster? Thank you All once again!

You can expedite your EAD by either calling USCIS or calling your congressperson (either the rep or either of the senators) and asking for their help in expediting it. You need to have some reason (typically severe financial hardship).

Not sure about the AP, though.

It doesn't make the process any faster - just gets that particular thing done quicker. The green card is on its own timeline.

Well, for my ead expedite request, i simply walked into my congressman's office, met the staff and told them i need it because of my new job offer... and that was done... My congressman rep got on the phone with the NBC representative, that deal with only congressional request and had it approved. I thank the guy and drove home, to get an email of approval. Please don't feel like that will hurt you case my trying. you will be suprised with the outcome. Understand that your Congressman will probably never see your paperwork. He/she has a large staff of specialized people in their twenties who handle 99% of the mail and email.

Thank you all for the replies. I can't believe I would be able to solve ALL my queries in less than 6 hours, where a lawyer would charge me 1000 bucks for the same! Very impressive forum, and even more impressive members indeed.

Now here is probably one of my last queries for now - this one is related to i864 affidavit of support. Since my wife is still studying and doesn't have a job yet, her dad would be showing financial support to me, basically becoming a co-sponsor. Now, I kind of understand the documents he needs to produce to support the affidavit - Financials, tax returns, bank statements, assets,etc, Now, as a cosponsor, does he need to fill in a separate i864 and my wife needs to fill in a separate one? Any other specific precautions or advice on this regard?

Yes, your wife has to fill I-864 as a primary sponsor even if her income is 0. Her dad has to fill another I-864 and check the box where it says joint sponsor. He has to include last 3 years taxes (tax transcripts), and if he meets poverty guidelines there is no need to include assets etc. And her dad needs to include proof of citizenship or permanent residence ( passport, birth certificate or naturalization certificate or if PR , copy of front and back of his green card.)

I almost understood this reply, but let me just clarify it further. My wife, who would not be able to meet the sponsorship income requirements, would fill up the i864. Her father, who becomes the joint sponsor, would fill out the i864 too. And then his wife, since she is included in the assets/tax returns, would fill out the i864a. Am i correct? Does her dad need to fill out the i864a?

So, my wife finally filed for my immigration today... and the long wait begins :)

i again am back with a couple of questions!

--> How long would it be, before they send me a letter for biometrics?

--> If we have filed in Chicago drop box, and right now im in LA, can I go to the USCIS LA office?

--> When can we start expediting the EAD and AP?
