F1 Student filling for AOS

Good evening all,

I'm a French citizen currently enrolled at a university on a F1 student Visa. My fiance (who is a USC) and I are getting married in a few weeks and we are now starting the process for my AOS (we will obviously submit the forms after being married). I have the following questions concerning the process in general and the forms in particular. I thank you in advance for your help!

General questions:

#1: I’m on F1 visa. I don’t think I have an Alien registration number (but I have a SSN). If you think I should have an Alien Registration Number, where can I find it.

#2: We're getting married in a few weeks and I would like to take my husband name. However my passport, DL, bills, rental agreement, etc are under my maiden name. Which last name should I put on the forms? Is this going to be a problem if my green card is under my new name (husband’s) and my passport, etc are still under my maiden name? Could I make the name change on my passport and Driving license after receiving my green card? or is it better to do it before applying?

Form-specific questions

Form I-130:

#14: Date arrived: should I put the date on my current I-94 (May 2010) or the date I initially enter the country on my F1 visa (August 2006)?

#16: Has your relative ever been under immigration proceedings: What are Immigration proceedings?

Form I-131:

#3: Should I put F1 or Pending AOS?

Form I-765:

#16: Eligibility Category: I’m a F1 student, getting married to a USC. I’m NOT on a K visa. What should my Eligibility Category be?

Thank you for your answers,

FrenchWifi

you dont need it know. once you send your package, they will assign you one

Put your husbands last name. and if you travel you have to carry your mmarriage certificate if your passport name is different. I think you can change it anytime, before or after

I have a follow-up question. I'm also in the situation as FrenchWifi (F-1, not on OPT, doing AOS). I'm a teaching assistant (I'm a grad student) at my university: Can I continue to work on campus during the period my immigration status is pending (i.e., before I get my EAD)? I know my F-1 status is no longer valid once I receive NOA. Thanks!

ROC

04/06/16

- I-751 mailed by priority

04/08/16

- NOA1

11/30/16

- card ordered (no interview)

Provided you do not violate your F-1 status in any way (take unauthorised work, stop going to classes, have your SEVIS record terminated, etc.) then you remain in your F-1 status even after filing for AoS. If at any point you take an action under your pending I-485 (stop going to classes, work for a non-campus employer, etc.) then your F-1 status is gone and you instead fall back to a "pending AoS" status.

Some students who are filing for AoS maintain their F-1 in case their AoS gets denied, meaning they have their F-1 to fall back on. For most people it won't be an issue, however.

If you're a funded grad student, there's really no reason not to maintain your status. My wife kept TAing while undergoing AOS.
