hi everybody! im new here :) just want to ask for everybody's advice for a faster way to be with my bf here in the u.s i was thinking about a k-1 or k-3 visa but right now i cant apply for a k-1 because im not yet a us citizen (ive been a resident since 2007),so i still have to wait for 2 yrs to apply for naturalization..then if i go with a k3 visa (if we tie the knot 2011), im thinking that it would take a longer process because what ive heard is that k-1 is faster than k3...pls need ur advise... just want the fastest way to be with my <3..thank you[/font]

I am going to ask you the following questions. Once you answered we can give you better advice.

Is your bf currently in the US?

Is your bf and you from the same country (born - citizen)?

If your bf is in the US is he here illegally?

As for the confusion between K1 and K3 - You can only apply for K3 once you have applied for the I-130 which takes a little longer than the k1 but for different reasons. With a I-130 k3, your future husband will get a green card after he is approved. With the K1, once your fiance is here, you still need to adjust status. BTW you need to be a citizen for the K1, also going with the K1 will cost you more than going with the I-130 about 1100 dollars more than if you do and I-130 which requires you to get married first.

K-3 can only be for USC's as well...

YMMV

With a I-130 k3, your future husband will get a green card after he is approved.

I hate to nitpick, but on a K-3 visa - is impossible to get a greencard 'after he is approved' - one must file for AOS, after arriving in USA.

gelatin26 If you marry him soonish, then file the I-130 (only) - expect (as a Permanent Resident, not USC) a wait of 2 to 3 years before the I-130 is approved, another 3 to 5 months for NVC Processing and an interview date.

PR's not eligible to file for K-3.

So, dig out your calendar, mark the date of you receiving yer US Citizenship, then figure out what kinda timelines you're gonna have between a K-1 (filed as a USC) vs an I-130 (filed as PR) and make your own decision on what to do, ah ?

Some light reading for you, as well ?

K-3 administratively closed - http://www.visajourney.com/news/2010/02/07/department-of-state-to-close-k-3-visas-if-i-129f-and-i-130-petitions-approved-and-received-together/

Good Luck ! (really - do the calendar work - put pen to paper, figure it out )

anything while you're still just resident will take from 3-4 yrs, maybe even more.Been through that, know that.Well, with citizen will take 6 mos...So whatever you decide, you have to wait since you're still resident now,as you say.

I waited 4 yrs(resident-father and husband) and my husband's case took 6 mos,but I am citizen.
