what to include in i-130 package

hi everyone,

we are thinking what we need to include in the i-130 package, and what we found is that we should include evidence of bonafide marriage; we have photos, shared lease, share bank account, marriage certificate, 2 affidavits from family and friends - would that be enough?

another thing: since I came on tourist visa with intent to just visit, and now I have to prove it - do I submit those proving things (like return tickets, affidavits from friends) with I-130 form for visa fraud suspicion? or do I bring those proves with me later to the interview?

please, anyone, help!?

No need to freak out, be calm and take it slowly. The process can be stressful. Your initial evidence sounds good. Submit copies of your evidence with the AOS package and keep the originals for the interview. I didnt really overload on the AOS but included a whole lot of stuff just so they can have the stuff we have already done and now will bring the stuff collected between AOS and Interview and the originals from before.

AOS from F-1 visa (2 months 2 1/2 weeks or 82 days)

04/14/10 - Sent AOS Package

04/26/10 - Hardcopy NOAs Received

05/16/10 - Biometrics letter

05/19/12 - Successful Walk-in Biometrics in Dover DE

07/07/10 - Interview Appointment in Philly- July 7 @ 11:05 am APPROVED

07/19/10 - 2 YEAR Green Card received

Removal of Conditions (9 months 1 1/2 weeks or 285 days)

04/08/12 - Eligibility date

04/19/12 - Sent ROC Package

04/26/12 - Hardcopy NOAs Received

05/17/10 - Biometrics letter

05/24/12 - Successful Walk-in Biometrics in Dover DE

01/25/13 - APPROVED- ROC card production ordered

02/05/13 - 10 YEAR Green Card received

Naturalization (5 months 2 days or 155 days)

04/15/13 - Eligibility date

06/07/13 - Sent Package

06/20/13 - Hardcopy NOAs Received

06/27/12 - Successful Walk-in Biometrics in Dover DE

07/05/13 - Interview letter sent/In-line notification

08/14/13 - Interview scheduled in Philly @ 1:30 pm APPROVED

11/07/13 - Oath Ceremony

hi VJ people!

I asked this question and didn't really get the kind of answer I was hoping to hear.

I need to know if we need to include in our I-130 and I-485 forms things that prove the initial intention of coming on B-2 visa to avoid the visa fraud suspicion? or do we keep those things to bring them with us to the AOS interview? please help folks!!

Since they don't ask for it, I would vote no. If you did not misuse your tourist visa, why are you so eager to prove it?

Since they don't ask for it, I would vote no. If you did not misuse your tourist visa, why are you so eager to prove it?

hi there,

because we were told it'll be one of their concerns... we are not really eager to prove it, but if it'll be one of the reasons why they'd deny AOS, then we'd prefer to provide with those proofs.

anyway,... now I don't really know what to do...

You don't need to send with AOS package your prove of non-intent. You can bring it to the interview and show it if they ask.

I'm planning also bring it to the interview, but I have never heard anyone to be asked for it.

I have never heard of anyone being asked about evidence proving lack of intent during POE.

But I have heard IOs directly asking applicants:

1. Did you have any intent to get married, adjust status and obtain a permanent resident card before or when you entered the US?

2. What did the officer at the POE ask you when you entered this country?

3. Did you get married to evade the immigration laws of the United States?

04/02/2010: AOS I-130, I-485 and I-765 mailed by UPS 2nd Day Air

04/06/2010: Delivered, Signed by Chiba (Day 1)

04/13/2010: Checks cashed, NOAs received via email and text (Day 7)

04/19/2010: Hard NOAs for I-130, I-485 and I-765 received (Day 13)

04/23/2010: Biometrics Appointment received (Day 17)

05/04/2010: RFE for I-864 received (Day 28)

05/06/2010: RFE for I-864 mailed back (Day 30)

05/12/2010: Case processing resumed (Day 36)

05/14/2010: Biometrics Appointment, I-485 and I-765 touched (Day 38)
