Hiya all to reading this.... I received a RFE letter the other day, we have been given 87 days to send in the info and i was wondering if someone could make it a bit clearer for me as to what it is i (or my wife the US citizen) need to do.

Below is the list from the letter...

[x] Form I-864 Affidavit of support was submitted however it was not from the petitioner/sponser.

Submit a completed form I 684 for the petitioner/sponsor listed on form I-130 or I-129f. Even if a joint sponsor will be used, the petitioner/sponsor must submit for I-863. Also Provide a copy of the petitioner/sponsors most recent federal income tax reports.

[x] The joint sponsor on form I-864 Affidavit of support, must submit all supporting tax documents (W-2's, 1099s etc) submitted to the internal revenue service (IRS) for the most recent tax year.

That's all i got, i know to most (if not all of you) that sounds pretty simple, but i just need someone to put it into clear plain English....thanks.

We don't know your case, so any "clear English" is going to be based solely on what you've posted about the contents of the RFE notice.

It sounds like you sent one I-864 only, and it was from a co-sponsor that you are using. That was your first mistake. The petitioner who submitted the I-130 or I-129F petition is ALWAYS the primary sponsor, even if their income is not enough to qualify them, and they ALWAYS must submit an I-864 and supporting evidence. The I-864 is a contract, and USCIS needs the petitioner's signature on that contract.

Second, it sounds like you didn't include the necessary evidence with your co-sponsor's I-864. They want a complete copy of the tax return the co-sponsor submitted to the IRS for the most recent tax year (which would be 2009), or a transcript from the IRS for that tax year. Either your co-sponsor didn't include all of the necessary documents, or they didn't include a copy of the tax return for the most recent year. All necessary documents would include every document that would be required in a tax return package submitted by mail to the IRS, and the 1040 form must be signed. A much simpler alternative would be to get transcripts for the most recent tax year from the IRS - no additional documents would be required. The most recent tax year is 2009, so that's the return that must be sent to USCIS. A previous year's tax return (2008, for example) would not be acceptable, even if your co-sponsor asked the IRS for an extension to file.

We just got an RFE for most recent tax docs for the joint sponsor too. I think it is because when we filed, it was last yr. So he only had 2008 docs. Now its 2010 and he should have his 2009 docs and the USCIS wants to see them. So, that is what we got.

Petitioner (your US citizen wife) need to submit completed form I-864. Plus supporting documents such as 3 years federal tax returns and w2's.

[x] The joint sponsor on form I-864 Affidavit of support, must submit all supporting tax documents (W-2's, 1099s etc) submitted to the internal revenue service (IRS) for the most recent tax year.

If you have a joint sponsor, he/she needs to submit a completed form I-864 plus supporting documents such as federal tax returns, W2's and proof of citizenship ( Birth certificate or Passport )
