Hi guys.

Unfortunately we got an RFE for 2 passport photos of the beneficiary. What I'm wondering is, if our agent is our lawyer and he's the one who has filed everything for us, does he have to respond to the RFE ? Or can we do it ? My husband has 2 photos of me ready, and it would be way faster for him to mail them to the NVC instead of waiting for the lawyer to do so, but can we?

Please let me know, I appreciate your help!

I would contact the lawyer you're using and ask him/her if they're going to handle it. The prompting by you may not hurt either, getting the lawyer to do their job in a timely manner... :)

hmmm we did not use a lawyer, but maybe you can send it yourself and tell your lawyer you sent it?

or do as mike said and ask the lawyer.

Well our lawyer did answer my email but he asked for time to review the letter. And that's what we don't want, any more time wasted :(

Our lawyer says they did send the photos with the packet. However my husband (USC) measured them (he has an extra 2 of the ones we originally sent) and he says they're 2 by 1 3/4 instead of 2 by 2, do you think this might be why they're requesting them again? I wanted my husband to just send in the ones he has since it would be faster but now I'm wondering if I should just take the pics again and make sure they're 2 by 2... What do you think?

I would get the photos taken again, making sure you tell the photo place that they need to be passport style photos for US Immigration and give them the required measurements. Printing out the requirements from the National Visa Center and showing them the requirements in print wouldn't hurt. :)

i don't think our photos were pefect squares.

we just did the tokyo photo booths that have a passport size option in the menus. they looked to be more rectangular. so i don't think they are that strict about the 2x2 rule. as long as it's 2" high??

Oh man I'm not sure what to do :wacko:

Yeah wouldn't think they would be like that for a 1/4 missing in the pic but who knows, the thing is we don't know for sure if the pics our lawyer sent were lost or they just won't accept the ones submitted. The checklist only says: MISSING DOCUMENTS LIST. I wanted my husband to send them overnight ASAP because If I do it would take a bit longer to get there...

Just an update, I took the photos again and made sure they were 2 by 2 and sent them by Fedex. They were delivered yesterday, now we're just waiting and praying.
