It happens in the US too - Courts can and do overturn contract law if the terms of the contractual agreement are found to be unfair, or if one parties interpretation of them is unreasonable. Happens all the time.

Have you ever watched any of those Court TV shows?

We must be in a different US. Next you are going to tell me that workers here have the same rights as they do in the UK or AUS. Remember this is the place, where you can be fired or downsized at a moments notice. Realistically, what difference is there in this case? The school should have just stated that they are downsizing.

According to the Internal Revenue Service, the 400 richest American households earned a total of $US138 billion, up from $US105 billion a year earlier. That's an average of $US345 million each, on which they paid a tax rate of just 16.6 per cent.

I think you're trying to change the subject.

It is a fact that contract law is not inviolate and cases of this nature go to court all the time.

The fact of the matter is that the woman was told explicitly that her pregnancy was "immoral" and that had she not gotten pregnant when she did that she would still have a job. This is blatant sex discrimination. There is no way around it.

It's also blatant discrimination against immoral people like me (by their definition) - like the governors have never slapped their salami or looked up when they are on the escalator and there is a pair of legs with a mini skirt in front of them...

I think they should all be fired for hypocrisy which is also immoral - probably more so.

I understand that it is being said she was not fired for being pregnant... but moreover the fact that she had sex and was not married at the time... the only way they knew she had sex was the fact that she became pregnant... so it goes back to the Pregnancy Discrimination Act.. unless they saw the video....

At this point she does not have to prove much as the burden goes to the employer proving that it was a result of ethics/morals rather than pregnancy... not likely to happen given they found out about the act after she said she was already pregnant.... I swear this sounds like a damn lifetime movie plot....

Perhaps you guys missed the part of private. What's hypocritical is what and where the boundary is drawn regarding what is considered private in this country. With some things in private, you can pretty-much get away with murder; yet with others, we apparently want to join the first world again.

Had this person been "downsized", it would have been end of story. Akin to a private corporation doing as they please. However, since a religious school made the mistake of being honest, they are getting flogged for it.

Since it was Florida.. an at will state... they didnt need a reason.. the fact that she was preg threw a wrench in the termination.. if she was gay instead of preg.. it would be a non issue... they could legally give her the boot for immoral acts for being gay if they wanted and get away with that...

But once she became pregnant..it went from private to public... its only because she was pregnant.... if a man had sex... they would not know because he could not get pregnant... but only for the fact that she was pregnant did they know she had sex before she was married...

I agree it should be 'private' but they held the fact that she was pregnant and exactly how pregnant she was against her as evidence of the private act. Since it is an at will state.. had there been no pregnancy.. the issue would be totally different... they would likely get away with the termination based on morals... they didnt need a reason since it was at will but the fact that they gave one made it easy for them to explain why.. as long as she was not pregnant... but being pregnant was the evidence of gettin some before marriage.

Yes, the school made a mistake here. When firing/downsizing someone or even when making a decision not to hire someone, you should never, ever cite a reason. Given the society we live in, this should be elementary to any employer. Citing a reason opens you up for lawsuits while firing someone for no reason is perfectly legal.

She was fired for having sex outside of marriage. Gay sex is sex outside of marriage, at least in Florida. The two could be argued as being equal.

It ain't for lack of trying!

What's so funny is these dinosaurs from the 50's spend all their lives worshipping a guy who was born of a virgin, but they find it's irrefutable evidence of sex for teacher to be pregnant.

Seems their imaginations can only be stretched once.

What did the school governors in galilee say ? Wish I had been a fly on the wall in that meeting. "Don't gimme that Mary, you insult our intelligence by insisting you are a virgin"

Admit it - it's was that old guy with the beard wasn't it ?
