from my understanding the pics that you sent to the uscis for the I-130 will not be returned to you. I am not sure if you sent in a request to return them if they would even do that then... I know at my husbands interview the pics that I sent in were not returned..

somebody has the negatives or digital images, somewhere, right?

Suggest to pay for a reprint.

is weird situation for India?

Most Guangzhou(China) filers get their photos back (non-electronic filers) on interview day.

The photos are supposed to travel from USCIS to NVC to India, are kept with the casefile, and

SUPPOSEDLY you can ask for them back, on interview day. But, you have to ask.

there is huge difference between :

1. stuff not returned on interview day and

2. 'we asked for it, they gave it to us'

IMO, when #1, no one inquired about it at the interview. There is no hard rule for returning - IMO, you must ask.

At my interview, I was returned everything that was submitted to NVC (well, most of it) but nothing that went with the original I130. The pre-screener even showed me the wedding pictures I'd sent in with the first submission but she didn't give those back to me.

We got everything back that was originally sent in with I-130, AOS, and IV packet. But, then we did send in the original AND photocopies of it all...

What do you mean, fake marriage pictures? You got married, you're applying for a CR-1 based off a legal, valid marriage certificate, yes? And THEN you plan to have another ceremony in accordance with Sikh traditions and customs? Do I have this correct?

My husband and I got married under the Special Marriage Act (no traditional rituals and stuff, besides he's not a Hindu and I'm not a fan of convenient conversions). Whenever we go to India next, we'd like to have the full-blown Bengali wedding with song and dance and seven rounds around the fire and all the hoopla. I don't think that will be a problem.

like i went to india on 2008, and my return back to usa was like 6th may and i met this girl in india so it was 27th of april n she asked me to get her marry,so i decide now we dont have time so wht we do is we will just get married in court n get pappers n when i get my us citizen in 2009 i will submit our marriage certificate,so to obtain marriage certificate they ask us our marriage pictures, so we decide lets go to sikh temple n take picture but not real marriage just showing tat we r getting marriage but we wasnt,so when i came back applied n submitted i sent our pictures with i-130 n later on i found out i lost the copies of it,so next month im getting married on 25th n 29th is interview but on 25th we r taking marriage pictures,im just worried wht if i take new pictures n the person already have old marriag pictures,,,:( u think the person will have old pictures?

Ok. I'm getting confused. What do you mean by a fake marriage? Like you just went to a temple and took some pictures there? Is this even a bona-fide relationship? You met this girl and she wanted to marry you? For what? A greencard.

I honestly don't mean to be rude, I'm just trying to understand your story.

Ok. So you have a marriage certificate (which for all intents and purposes makes you legally married, I'd say although if that marriage certificate was procured under false pretenses--that is to say, you produced "fake/staged" pictures, then I don't know whether the marriage is considered to be legal or not).

Your interview is on the 29th and you will have your 'real wedding' on the 25th, yes?

As to your main question -- the embassy will have anything you submitted to USCIS/NVC with the I-130 and all the other forms and documents.

Ah. I see. Yes, you can have your wedding 'again' this time complete with the all the elaborate hoopla. I believe VJ member Hobokenworkingmen did something similar. You can talk to him. He had a 'quickie' wedding so they could get the immigration process started and then he went back to India later and had a full-blown wedding.

As long as your wife can explain this, she'll be fine. But do NOT use the words 'fake marriage' AT ANY TIME.

Yes, her visa will be attached to her passport. Chances are it will be couriered to her address with the mysterious envelope that is not to be opened.
