In two weeks I'm going to fill the AOS for my wife she is on a k1 fiancee visa.

I started to work two years ago that's mean i only two taxes trascrit above the poverty line

can i just fill the I 864 affidavit of support with two tax transcrit or do i need a cor sponsor if i need one does the person need to have three tax transcrit or just one since I already have two.

You will still need to include some information about 2007...I did not make enough in 2007 to file taxes, so I included a letter to that effect and my W-2 from that year plus some other general info about why I didn't file. If you were, say, a student that year just include a letter saying that you didn't work in 2007 hence didn't file taxes.

If you make above 125% of the poverty level NOW you don't need a co-sponsor. Just include the 2 tax transcripts you have (assuming 09 and 08) and the letter saying why you didn't file in 07.

As per item 25 on the I-864 instructions, you are only required to submit the most recent year's tax information (i.e. transcript or photo copy of forms with supporting information), so information from 2007 is not required. They do state, however, that you CAN submit 3 years' worth of tax information if you think it will make your case for sufficient income stronger.

So if you have a letter from your employer stating your position is permanent or some other indication that you'll be making this income for the next while, tax information from 2007 is somewhat superfluous anyway.

OP - you only need to meet the income levels for the last year, the previous years returns are just in case you wanna show more info.

Also, you do need to have at least FILED for the last 3 years. If you didn't file in any of the years and you were supposed to then you must file before applying. If you didn't file because you didn't need to, you must include a letter of explanation.
