I-864 Affidavit of Support Questions

Hi Everyone,

I'm new here. This forum is a great reference. I am currently putting together my forms & paper works to submit by the 2nd week of June.

Situation:

Me = Forms 130,concurrently filing 485, 864,824 (for daughter's petition),693,765 - (overstayed B1/B20) - Married to a USC

Daughter (Minor) = In my country - Form 130 will be filed with my forms and paper works - Husband petitioning her

Questions:

1. The I-864 instructions said that if there are 2 separate petitions then each will need affidavit of support and supporting documents of 864. Is this the way to go for my daughter's application? or should my husband include her on Part.3 #9 and just make copies of my 864?

2. Part 5 Sponsor's household size - My husband is sponsoring me, should he leave 21.c blank since it says dont count anyone twice and I am already counted on 21.a (person sponsored in the affidavit)? I know this sounds stupid but I am confused.

3. My husband doesnt have a pay stub, since his check directly goes his bank. Will a bank statement with his salary amount reflected a good substitute for the pay stubs? or should we ask his HR to make a letter regarding this matter? He works for a huge corporation and it usually takes awhile for paper works such as this to be processed.

Your inputs, suggestions will be truly appreciated.

12/30/10 - Applied for SSN

01/03/11 - Received SSN

01/06/11 - Received Interview Letter!! Yahoo!! Feb. 8 it is!!

01/08/11 - Interview Approved!Green Card Stamped on Passport!!

01/14/11 - Approval Notice I-130 & Welcome Letter!

01/18/11 - Received Green Card in the mail..

1. 2 x I-130's = 2 x I-864's

2. If you are counted in 21a then you are not counted in 21c

3. Bank statements and letter from employer

As an aside: (not sure how it works in the US but time & wages records are mandatory in Aus) He should have some kind of record of what he has earned/accrued each week even if it is direct deposited.

Agreed. Both on the Aus and US front. My husband gets his pay direct deposit and his "large corporation" (Fortune 500 company) has the pay slips available online for printing at each branch. I don't know the name of the system. Have your husband speak to his manager about accessing his payslips. They should also include how much sick pay and annual leave have been accrued (I would assume as is the norm in Aus and for my husbands employer).

I'm pretty sure it's illegal to not have SOME record somewhere...

Thanks for your inputs, Deb + Steve & Vanessa & Tony..

He usually receives email when his pay check is deposited, but he deletes the email after that. He just started not deleting the email for the April paycheck.

I'll ask him if he has the same system that you're talking about Vanessa, I know that they have some kind of record keeping but I was told we have to request that from their HR department which will take anywhere between 2 to 3 weeks.
