I have a friend who went to the Philippines last month to meet up with his filipina GF. Everything's cool and now he's planning on starting a K-1 Petition for her. The thing is, his GF missed her period for 2 weeks now and they're worried that she's pregnant. If given that she is pregnant, how will that affect the K-1 petition?? will that deem the it void?? if not, what are the things that she could possibly undergo thru the process??? what should be the best approach for this?? any info is much appreciated. No, not at all.

OTOH, a legal marriage will void out / invalidate a K-1 visa, should the Consular Official learn of it , on or prior to, interview day.

If she has the child prior to arriving in the USA, she can file for CRBA at the Embassy in Manila (no need to file I-130 for the child, unless USC father has less than 5 years of USA residency )

Fiance visa/ process is still valid; lots of people have kids out of wedlock these days. If the child is born prior to the visa interview, the household size goes up one for the purposes for the affidavit of support. If she is still pregnant during the visa medical, there will be some things that cannot be done (vaccines, x-ray); she can get a waiver for those and have them done before AoS in the USA.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
