Hoping someone can shed some light on this.....

We received a RFE and our Lawyer has contacted us saying it is to do with the Adam Walsh ACT...

She said it is part of a new form USCIS is making people resond to.

Has anyone else had to respond to this and what is it????

In short, a petition receiving an RFE in connection with the Adam Walsh act indicates the petitioner has a criminal history that includes at least one conviction for a sex crime against a person under age 18.

Facts are cheap...knowing how to use them is precious...

While this is correct in that Adam Walsh act deals with sexual convictions of a minor, it actually covers more than that. I have recieved a memo that was issued by the USCIS issued to all Directors entitled, "USCIS - Guidance for Adjudication under the Adam Walsh CPSA" that states the implimentation of the Adam Walsh act will also include other felonious acts not actually mentioned in the Bill itself. ( i will be happy to send to anyone requesting in a PM)

I do agree that at a minimum, the petitioner probably does have a conviction, or at least they have information, they are wanting to investigate to determine if it falls in the guidelines listed in the memo or the law itself.

Thanks for the information on this....We received what our RFE was about and the lawyer did not explain that all it was. Was that hubby to be did not tick a box on page 2 of the F129 form. You would think in paying money to a lawyer they would be checking and double checking forms before they are sent in.
