Which Date Do I Use On NOA?

Hi

I'm a bit confused with the NOA dates.. There are two dates on the NOA forms, one is the received date (mine is March 18), and one is NOA date (mine is March 25). I know to expedite your case (i.e. biometrics and EAD), they ask you to wait certain number of days. But which date do I count from? The receive date or the NOA date?

Current status: H1b and employer-sponsored AOS

02/20/2010 - Wedding

03/16/2010 - Sent AOS packages (USPS priority)

03/18/2010 - Package delivered at Chicago Lockbox

03/25/2010 - Checks cashed

03/26/2010 - All 4 NOA received. NOA date March 25

03/29/2010 - I130, I485, I765 and I131 touched

04/16/2010 - Biometrics notice received (finally!). Appt date is Apr 29

04/19/2010 - Walk-in biometrics done; I765 and I485 touched

04/20/2010 - I765 and I485 touched again

05/10/2010 - Interview Notice received! Called to expedite EAD

05/11/2010 - EAD expedite request rejected =(

05/17/2010 - Contacted congressman for EAD expedite

05/19/2010 - EAD and AP approved!

05/24/2010 - EAD approval email again. ??

05/31/2010 - AP received

06/05/2010 - EAD received

06/12/2010 - I130 and I485 touched

06/21/2010 - Interview

Thank you for your reply. Maybe I didn't explain is clearly... by Received date I mean the first date on the NOA, which is the date they got my package. NOT the date I received the NOA from them.

The received date is usually a week before the notice date. So I was hoping I can use that date to count.

Suggest you use the PRINTED DATE on the NOA-1, instead.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I just took my NOAs and I didn't use the right words. Sorry :)

Notice Date is actual date of a NOA. Count from that. Because your package could be received and be laying under the table without reviewing and knowing. Notice date is the date when you were entered in the system.

I know it's minus a week but be patient ! :thumbs:

This is a tough question. It seems to me you should be able to go with the earliest date they acknowledge your application, which would seem to be the received date. The second date is only labeled Notice Date. If it said Action Date or Acceptance Date, then I might be inclined to think it was more significant than Received Date, but Notice doesn't carry any sort of significance to me in terms of official actions than that it's the date they printed and mailed the letter.

I guess it's just a week's difference, and if I couldn't get a more definitive answer, I would probably go with the later date to be safe, but if you could call the helpline, you might get something more official.

4/24/10 - Received hardcopy NOAs (Day 10)

5/14/10 - Biometrics taken. (Day 31)

5/29/10 - Interview letter received 6/30 at 10:30 (Day 46)

6/30/10 - EAD received in the mail

Thanks everyone. I did more research and am going to assume the date to use is received date. I'm basing my assumption on page 17 of this document

It says "Ninety (90) days of receipt of applications filed under categories other than asylum-based", which sounds to me like since the date they received it.

I know I sound pathetic analyzing details like this, but I really need to start a job soon, and according to this document, I can file a EAD service request after 75 days (not to be confused with expedite request. You don't need to show evidence for financial difficulty with a SR). So I'm trying to see what is the earliest date i can file for that SR so I can have my EAD ASAP.

I agree, according to the wording of that document, the received date seems the valid one. I guess it makes sense if they are going to even include the date it was received, thereby making it official, it could be the date to start counting from.

I think pretty much everyone in the stages of this process that we are in, especially when filing anything, analyzes details to the nth degree.

I know I didn't exhale until I got my email NOA on the notice date even though I had word from USPS that the packet had been received earlier. And I didn't even notice there was a received date on the NOA until I read Summerluv's question and looked at our NOAs. I assumed she/he was confused and was talking about the receipt from the postal service. But the fact that they do actually acknowledge the date my packet was received makes me feel a little closer to completion. Stupid, I know. But I'll grasp any straws.

There is only one date printed on the Notice of Action 1 - you receive that form after your case is initially processed about a week or so after you file your initial petition. It then gets sent to the Service Centre for processing. The date that appears on your NOA is the date the US gov't gives you. Once you get NOA2 , again that date on the form is the date you use. Pretty straight forward overall.

I think most of the people here do get two dates on the NOAs (received date and notice date), and we only get one hardcopy of NOA per application. Maybe your situation is different from ours?

That's what I thought, but there actually are two dates on the NOA 1. At least there are two dates on mine, and apparently on Summerluv's as well. I don't know if this is a new thing, or if they have always listed the received date as well as the date they sent out the NOA, but I didn't even notice the received date until I read Summerluv's question and checked.
