to re-file a new I-130, use the address listed here:

but - your husband really should make a phone call to NVC, get a human, and inquire if the prior I-130 is still at NVC, or is not at NVC, prior to filing a NEW I-130.

If it's still at NVC, then I strongly suggest he jump start the NVC Processing.

Would it be best just to call the Embassy Manila since our case was forwarded to them from NVC and got our case number before? appointment? and cancellation?

You've been told over and over again to call NVC. If NVC doesn't have the case, USCIS does. Only USCIS can invalidate a petition they approved. I-130 petition approvals do not expire.

Frankly, I would advise you to obtain professional assistance as you seem to be having great difficulty understanding and following the excellent advice you're being given here.

Call NVC. Seriously ! they are open till 00:00 E.S.T. M-F,

I've mentioned this repeatedly.

Call NVC. Get a Human, give the I-130 USCIS casefile # (starts with EAC or WAC) and inquire for status.

Your new question, to call NVC or USEM Manila, is getting stretched, to me, as you've already called USEM Manila, and know the result from there. There are seperate proceses, seperate things to do, and you've decided not to 'make the call to NVC'.

IMO, 'making that call' to NVC should be at the TOP of that decision tree, for 'what to do next', based on the outcome of that telephone call. I do pray to Shiva that you will make a new decision, to call NVC, talk with a human, and GET THE STATUS of the original I-130 petition and find out the location of the casefile.

If, in fact, NVC still has the I-130, then YER HUSBAND can kick-start the NVC Processing for this petition, and NOT have to file a NEW I-130 petition.

I think I've been clear about this - but - may I ask one personal indulgence? Would you PLEASE click the 'download' link at the bottom of this window, and then EMAIL the resulting output file to YOUR HUSBAND, and ask for HIS INPUT ? Please?

I wont be able to send the files to nvc email address. Why is this???

Because the PI is not a country that participates in NVC Electronic Processing.

There's only 3, at this time. PI is not one of them.

Yer Husband would have to handle NVC Processing via Postal/Courier delivery.

HOWEVER, you can handle the DS-3032 via ASCII TEMPLATE EMAIL -

When my husband called the NVC they were asking for our birth certificates and to email it on this add which is nvcinquiry@state.gov and as i tried i cannot get through :( And said that they could not give some more details about the case until we can send our birth certificates, we don't know why i mean they don't give definite answer and i am very disappointed about it.

OK - they are asking for yer birth certificates, IMO, to prove up WHO YOU ARE. That's normal, but rarely utilized. Don't sweat that.

Now, as to WHY you cannot send email into nvcinquiry@state.gov - I've no clue - it MUST be some problem with YOUR computer. MANY OTHER PPL (thousands each month) send stuff in to nvcinquiry@state.gov with success.

DOES YOUR HUSBAND have a scan of yer birth certificate? If so, have HIM send yours and his , in, to that email address, with some reference (in the body) to the prior I-130 USCIS casefile number.

USUALLY, it's enough for the USC spouse to give the casefile #, the dates of birth (yours and his) plus the names, and then jump start the case at NVC, via telephone. For some reason, that's not working for your husband. I suggest to keep caling and to try, each day, over 3 days (monday, tuesday, wednesday) until an NVC Tele-Operator accepts the info via telephone. If/when the info is never accepted via telephone, then send it in via email.

First of all I apologized that i asked too much, though I am very thankful for you both for the responses you've given us.

What do you mean by PI?

DS-3032 Email Template ??Are we supposed to send the DS-3032 even if they dont ask yet?

PI - the Phillipines - sorry - it's a common abbreviation.

at some point, the DS-3032 MUST be sent it - I am suggesting to use the TEMPLATE to email an ASCII (text-only) version, once the MNL casefile is available. So far, I am certain you have USCIS casefile # for that I-130 petition, but I'm not certain you have NVC/MNL casefile #.

You'll get the casefile # either from the AVR, or via talking to a human, at NVC.

You can't send in the DS-3032 without having the MNL/NVC casefile #.

What is your husband's input/take on the NVC process, and this particular thread in VJ ? If he needs some coaching (from me) via telephone, I'd be happy to contact him , and go over this process WITH HIM. But - IF HE'S READ everything in this topic, then he should already understand 'what to do'.

If he's not read this topic, IMO, he should.

Yes they said that the record was not right that is why they are asking for our birth certificates.

He did scan our birth certificates and when he was trying to send it , it goes back and says failure dont know what is wrong and he said today he will try to call the nvc again.
