uhm, ok, my fiance had a previous marriage in US and they got married too, here in the philippines.. they got divorced 2 years ago.. my questions is, even if he's divorce papers were done, is it possible that the consulate will ask the annulment papers even though they were divorced? hmmm, im kinda pissed off about this..

Actually, did your fiancée file to have the Philippine gov't recognize her foreign divorce?

To the USEM divorced in the US is enough but come CFO time if her divorce isn't recognized in the Philippines they won't issue her the CFO Sticker for her passport so she can leave the country!

The previous marriage which is with another filipina might just raised a red flag in NVC, or in the USEM Manila once you have your interview.

If I understand this right,your fiance is the US citizen and got divorsed from his previous filipina wife, if in this case you don't have to worry since you are the one who will be doing the CFO, his divorse paper should be alright, you are the one who needs the sticker not him.

And NVC wont get alarmed about it, since there is no fraud in marrying and divorsing , everything is done legally ,

well i have an uncle who got married to my aunt in PI but later on got divorced in the US. my uncle had a girlfriend again in PI that he wants to eventually marry but got denied for K1 visa because the CO stated his US divorce decree was not enough since divorce is not recognized in PI that he would have to get his marriage annuled in PI also since that's where the wedding took place...when he wanted to try and get married in PI when he went to get his legal capacity consent from USEM manila they also looked for his US divorce papers & PI annulment of the marriage so until now he is still in the process of getting the resolution for their annulment.

The CO was wrong. Here is the Philippine law. "As a rule, divorce is not recognized in the Philippines as a mode of dissolving marriage. In cases however where a Filipino citizen contracts a marriage with a foreigner, a divorce validly obtained thereafter in a foreign court by the foreigner spouse, i.e. the foreigner spouse initiated the divorce proceedings, such a divorce will be recognized under Philippine law (Article 26, paragraph (2), of the Family Code). The foreign divorce will have the effect of capacitating either the foreigner spouse or the Filipino spouse to remarry under Philippine law."

The info you provided is limited to make an assessment. But anyway, if your fiancé isan American citizen and he initiated the divorce proceeding, the divorce decree will suffice. No need to file for annulment in the Philippines but the divorce decree needs to be recognized by a Philippine court. Having said that, however, we have one American PI Forum member who was in the same situation where his fiancée was married in the PI, ex-husband filed divorce in the US, she did not file for recognition of foreign divorce decree, was approved for K1 visa and CFO also did not question her.

Ala swerte lang talaga kung matapat sa mahigpit na CO.

For the benefit of non-Tagalog speaking folks, Len86's question was:

"I have another question: how will I know when NVC has received the approved petition? Do I need to call them?"

Within a week after receiving you NOA2, you may start calling the NVC to follow up if you already have been issued a NVC Case Number (which starts with MNL). Once you have been issued a NVC Case Number, your file will be forwarded/endorsed to the USEM Manila through DHL.

A quick research on posts by thepizzadude will tell you when to call NVC, their contact number and how you can track the DHL package.

You don't NEED to call the NVC...however, I think a lot of VJ members have benefited from being proactive (that is, not just sitting around and waiting for things to happen), and this has resulted in early booking of interviews at the Embassy.
