Hi,

My wife has finally made it to America. Thank God for that.. It took a while before this day came along. The POE experience was good. She wasnt asked any unusual questions, but when i saw the visa, it stated CR 1 rather then IR 1. We have been married for 2 yrs (in March), and the visa was approved about 3 weeks after our 2 Yr anniv, so i dont understand why we have a conditional status? They gave a notice saying that in 2 yrs we need to file to remove the conditional status. What is the criteria for being in CR 1 and IR1?

I am confused.

I have seen posts here about something like this.

Contact USCIS and correct the error, if it is one. (INFOPASS)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Is the status based on the date that you file?

I thought the status is based on the day you receive the visa. Is that true? My wife didnt catch this untill i saw the passport when we got home. I am happy that she is here but i would have liked to not go through filling yet again after 2 yrs.

It's based on the date you enter the US. If you've been married for 2 years when you enter the US you should make the CBP employee aware of it to ensure they order your 10 year greencard.

this is what she needs to file this form is neede in able for her to remove the condition on her status the DATE starts when he arrives HERE in US look at her GC the expiration date is there too ;et say she got here sept 9 2009 her GC wil lexprie on sep 9 2011 it alst for only 2 yrs but before few mos it expire u guys have to file the removal of conditional status... they give conditional or CR1 visa to prove the legibility of the marriage to see if you are really married and not fooling the USCIS.. just go to USCIS website all your question will be there and try to call them if you guys are really confused....1800 375 5283 thats the NO. of USCIS.I HAVE THE SAME GREENCARD it last for only 2 yrs and next yr i have to FILE thethe same thing...

Not the point, they should have been given a IR-1 since they had been married for more then 2 years when she entered. Make an infopass and correct the mistake.
