We received the letter of RFE today. They are asking for 3 things:

1. Submit all supporting tax documentations (W-2s, 1099s, etc) submitted to the IRS from the petitioner/sponsor on Form I-864 blah blah blah.... of the most recent tax year.

2. The joint sponsor on form I-864, Affidavit of Support, must submit all supporting tax documentation (W-2s, 1099s, etc) submitted to the IRS blah blah blah... of the most recent tax year.

3. Submit evidence of joint sponsor's status.

Questions:

1. Will 2009 W-2 work? We already submitted the tax returns form 1040. We don't have 1099s. We only have W-2. Will that already work?

2. If our co sponsor has 2009 W2 or only 1099s, will that work also? Gosh this is so confusing me :-(

3. What evidences are acceptable? Is birth certificate enough?

4. Do they need the original copies or photocopies will do?

I would recommend that you order tax transcripts from the IRS for previous years, and send a COMPLETE tax return.

A complete tax return is all W-2s, 1099s and similar showing income recieved, AND all forms filed with the tax return. So, Not just the 1040s, but any schedules used for anything else. Don't send things piecemeal, whoever opens your package doesn't want to go through and find the two pieces to put together, and may not even look. Make it easy for them, because ultimately, YOU care a lot more about if they reject it than they do, right?

So, Send in transcripts for 2008 taxes (order from the IRS FOR FREE) and get the complete tax returns for 2009 together with all components as described above.

You can send a photocopy of the join sponsor's birth certificate, passport ID page, naturalization certificate or green card.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

1.) It's possible they've misplaced the 1040 - resend with a copy of the 1040 and all relevant W2s. Perhaps even include a note stating you did not receive any 1099s for the year.

2.) No. It's actually quite straight forward. They need the 1040 and W2s/1099s for each person filling out an I 864, for each tax year. There's no way to have just a W2 or 1099 unless you didn't file a tax return for that year for some strange reason.

This is why IRS tax transcripts are better to send - that has everything they need all on one form. But, water under the bridge at this point.

3.) Copy of the Birth certificate, naturalization certificate or passport if the co sponsor is a US citizen; copy (front and back) of green card if they are a legal permanent resident.

4.) Never send originals to the USCIS - you'll likely never get them back.

The RFE and biometrics appointment are essentially unrelated.

You should have received a letter with your biometrics appt time and instructions to take that letter with you to the appt. I don't know why you'd need to call them - guess I'm confused by your question.

thanks for your response. my question is simple. i asked if i need to call the ASC office and inform them that i am scheduled for biometrics on this specific date or not. just wondering. but i won't call anyway. will just bring the appointment letter and other required papers to bring.

Yes, go for the scheduled Biometrics. They are 2 separate tracks that join up at some point at the adjudicator's desk.

if you have a fax machine then they'll send it to you right away

I second that thought!!!! Getting the transcripts faxed will save you a couple of weeks. When I called I was able to get 2009 too and all of them within 10 minutes. In the past, when I requested them, it took about two weeks to get them in snail mail.

The ASC knows about your appointment - likely electronically, and most likely before you even knew of the date and time.
