I was wondering I am going to be coming up on my 120 days in May since my interview for Naturalization. So far I have received no response from USCIS since my interview on Jan 11, 2010. I understand that USCIS has 120 days to give you a decision, but what if they don't? What are my options? I know I could schedule an infopass appointment, I live 4 hours away and I would hate for them to say sorry go home no info. So far I have contacted my congressman and USCIS told them that they have 120 days to respond. So after the 120 days what's next?

11/02/09 Rec'd NOA date showing 10/29/09

11/09/09 Rec'd letter Bio Appointment

11/17/09 Bio Appointment 8am

11/20/09 Called FBI-Prints were sent back to USCIS same day.

12/03/09 Rec'd email from USCIS that the RFE was a mistake.

12/04/09 Rec'd email from USCIS saying that I have been transferred for an interview.

12/07/09 Rec'd letter for interview on 1/11/10 @11am in Fairfax, VA.

01/11/10 Interview completed. Passed test decision can't be made.

03/02/10 Contacted Senator's office...No reply yet!

03/04/10 Senator office called says can take up to 120 days.

04/12/10 Service request filed.

05/12/10 Contacted Senator's office again.

05/12/10 Told over the phone that I was approved. Believe it when I see it!

06/04/10 Senators office tells me the adjudicator who interviewed me thinks I have a criminal record. Send out all paper work showing no criminal record.

06/08/10 Leave for Canada

06/09/10 Get RCMP certificate showing no criminal record. Fax off to senators office.

06/23/10 Approved for Citizenship

06/24/10 USCIS contacts Senators office

06/28/10 Find out that I have been approved for citizenship and they are just waiting to schedule my oath.

07/12/10 Put in line for oath ceremony....wonder how long that will be!

08/18/10 Called USCIS confirmed they sent oath letter for 09/17/2010 at 9am.

09/17/10 Oath ceremony at 9am..... US Citizen!!!! Applied for passport.

I'm looking at your time line....if you received your Green Card in Nov. 2008, you are not eligible to apply for citizenship yet. It doesn't matter how many years you've been married, but how many years have passed since the day you got your Residency card. If married to the same person you can apply after 3 years passed the date in your GC or else 5 years past that date.

I'm looking at your time line....if you received your Green Card in Nov. 2008, you are not eligible to apply for citizenship yet. It doesn't matter how many years you've been married, but how many years have passed since the day you got your Residency card. If married to the same person you can apply after 3 years passed the date in your GC or else 5 years past that date.

Lissa04 applied for the Removal of Conditions/I-751/10yr green card renewal in November 2008, which is TWO YEARS AFTER her original 2yr green card was issued...

Therefore, her RESIDENCE SINCE date would have been two years before that, sometime in November 2006, or prior....

So she is eligible for US Ciitzenship, based on her RESIDENCE SINCE date, and in meeting other condtions required for the N-400 application...:thumbs:

Lissa04-You might want to update your vj timeline to reflect your 2yr green card info too....Thanks....

Ok...Now to the other issue...

Sorry to hear that you have had no response from the USCIS..Wow, I can't believe they are taking so long in your case! :blink: If I were you, I would contact your congressman again. As well, you can also try contacting your senator and/or other elected officials too. Sometimes elected officals need a 'nudge' too, to get them to work your case again, so it doesn't hurt to ask again (lol...I remember I had to ask my congressman twice about my I-751 case...but that's another story...). And now that your 120 days is fast approaching....The next option (though it is drastic), is to take the USCIS to court, as you are legally able to do such (I think there is some rule about this...maybe some other VJer can provide more details about that), to 'force' them to make a decision about your naturalization ceremony. You can also try contacting the USCIS again, but be prepared that they can be very mis-informed and would not help you too much there.

Again, you shouldn't have to wait that long....Keep on pushing them to make a decision about your case. And hopefully, a decision will be made about your oath ceremony soon. Hope this helps. Good luck and hope you get citizenship soon too.

So I called the useless line today, they won't give me any info before my 90 days which will be on Sunday. I guess I will be calling on Monday!

So you made a mistake on your posting and got corrected......It`s all good!

I would focus more on getting the congressfolks involved rather than driving 4hours to meet up an Infopass appointment- only to, perhaps, run into a bleary-eyed cust. service rep with no relevant info.

From reading this board, learned and instructed my wife to ask about the field offices policies regarding the oath ceremony and even requesting a same day oath. Should seem the obvious thing to do, but don't think about it after you passed your interview. She got a commitment, and with that commitment, had a leg to stand on when calling my senator for help. Worthless to contact the USCIS that I already tried. I also contacted my congressman, he really wasn't set up to handle immigration related problems like my senators' office was.

St. Paul already had a reputation for even waiting up to a year until they had about 3,000 applicants and my wife wanted to vote, that was also very helpful at the time, but no major elections going on now.

Mentioned a friend at the Chicago office that received an RFE for of all things, a joint utility bill, she made the extra trip, but heard nothing until 15 months later when she finally got her oath letter. She did not want to take the USCIS to court, but is an option, and sooner or later, you will get your oath letter.

With the commitment that my wife received that she should get her oath letter within two weeks, let four weeks passed, I called my senators office and informed her of that, and that my wife would like to vote. This was on a Friday, and heard her call the field office manager telling her one of our constituents would like to vote, is there anything you can do. She replied, we can hold a special oath ceremony Tuesday, and asked me if that was okay. Said, wonderful, we will be there. Two hours later, received my wife's oath letter via e-mail. That is something I cannot do.

Could be other reasons why you would like to get your certificate like applying for a government job or something.
