:help: I need some advice for my friend who is planning on getting marry to her fiance who was here on a H2B visa and it expired back in December of 2008. He tried to get an extension or obtained a tourist visa and was denied on March 2009. Her fiance is from Romania and she is a U.S citizen. They're planning on getting married next Friday April 2, 2010.

What are the steps that she (my friend) will have to take to get his application started? Will they have to pay any penalties?

The first question is, after the visa extenstion was denied, was the friend put into any removal proceedings or given a date that they must leave by? Is your friend still in the US?

Yes, my friend was given a date that he was to leave by, and yes, he is still here in the US.
