I submitted Josephines AOS about 3 weeks ago. I just received a RFE, they want me to submit a 2005 ITR with W2. I am on Railroad retirement, I do not get a W2 I get a RRB1099 I have already submitted the 2005 ITR and RRB-1099 form. I called the Railroad Retirement Board and they informed me that there is no other form that they issue. I've tried resubmitting the 2005 ITR and RRB-1099 with some window dressing and am hopeing it will pass through.

The interesting part of this is they said they cannot verify my income. If they cannot verify my income, why did they let her into the US in the first place?

All very frustrating. But when I think about it with the amount of people (employees and clients), papers, forms, laws ect. It is truly amazing that anything gets done.

Can you order IRS transcripts? That might be sufficient.

They're free to order and take approx. 2 weeks to get

You definately can need to order the tax transcripts because USCIS usually trust other government agencies than what we have to say or do. Or they might have misplaced your tax info, which happens a lot and want you to resubmit another one. If you submit your tax info again with the tax transcripts as back up evidence maybe they won't ask for other info. Good Luck :thumbs:

I had a RFE based on the Affidavit of Support, even though the requirements were met.

I just sent the whole thing again, exactly the same, but with a respectful cover letter, explaining everything, and that did it.

Keep in mind that a lot of the people working on our cases are, dixit an immigration lawyer, low-schooled people, and that they don't really know what they're doing. Sometimes it helps to give them a hand.

I think it's a good idea to include a cover letter with explanation, I'm going to do the same. Since you don't get W-2s you can explain to them that you recieve RRB 1099s. I am self employed but work with contractors and I get MISC 1099s. I will send a seperate cover letter for my affadavit and supporting evidence.

Thanks for the responses. I think a lot of this is just who you get and what day you get them. The 1099 is a very common Gov. form and should require no explanation. However a cover letter with explaination cannot hurt. Unless of course you get the person who is insulted that you would try to expline such a simple thing to them.

With this submission with the cover letter I explained taht I do not get a W2 form, that the Railroad retirement board does not issue any other forms. I also included a verification of income letter that I obtained from the Railroad retirement board last year, and computer printouts of my checking account with the direct deposits highlighted for the past three months.

This should be sufficent for anyone, unless I get the guy that is being divorced by a Philippina!!!!
