My wife and I just got married last sunday, however we have NOT filed any documents yet regarding the AOS process... We are turning in the Marriage liscense by hand tommorow and going to the Social Security office the same day for her name change. Is there going to be a problem changing her last name to mine since she does NOT have a social security card? My wife is currently a F-1 Student because we have not filed AOS yet. We are trying to get everything changed over before we actual file to adjust from F-1 to Spouse.

Has anyone else's spouse named changed immediately after marriage but before they filed any of the I-130,I-485 etc etc etc?

Does your wife have a social security number? but not the actual card? if she already has a #, it shouldn't be a problem to change it to her married name. However if she doesn't have a number assigned to her yet, you have to apply for AOS and you should be able to get a number until after you get an EA.

I tell you the above, because that's my case. I entered the country on a BCC Visa b1-b2, married last December, applied for AOS and now I'm waiting to get a work permit and be able to go to the SS office and request a number. I know that K-1 applicants are assigned a number when they come to the US but that wasn't my case and for what you said it isn't your wife's either. Good luck. I'm subscribing to your question and see what other people have to tell you.

She does not have a number or a card since she is a F-1 student until we start the whole AOS process and adjust... We would be going to the Social Security office with everything except a SS# and Card. She has everything from the I-20, I-94, Visa, Passport, Marriage License, Birth Certificate, etc etc. I am just trying to get everything with her name change straightened out before we send in our packet.

She has everything from the I-20, I-94, Visa, Passport, Marriage License, Birth Certificate, etc etc. I am just trying to get everything with her name change straightened out before we send in our packet.

We had to get my wife an SSN in order to get married (varies by state)-- so it's still in her maiden name. All the AOS documents are in her married name. We just got her EAD which I'm told is enough to go back to the Social Security office and get her name changed on that.

There really isn't anything else with her name that needs to be changed aside from SS Card if she just entered the US and has no records here anyway. If you don't need an SSN in your state, then you can just wait and get the social security card in the married name and not have to change anything.

I am in the same situation but if you read the instructions for the forms it'll tell you that the marriage certificate serves as an official NAME CHANGE for your wife SSN or not...

Ok so we had the marriage license recorded ONLY today at the courthouse, I'm thinking we should wait on doing ANY name changes at all until we get to the EAD portion during the packet filing process to simplify things?

I will just tell her to keep using her Maiden name on all documents until we get the EAD from the packet process and THEN change her name, names on accounts, Drivers license etc etc to my last name?

If you are going to use her maiden name, you have to use it on all applications. You can't use maiden on all except for I-765. Best think would be to fill the whole packet with her married name and after you get EAD, apply for SSN (which will come in married name) and then driver's licence, etc. F-1 students CAN get SSN, I was F-1 with a SSN, howevrer she will have to have a job offer from a campus employer first.

The way we did it was as such.

Maiden name on SSC (waited 2 weeks after arrival to get it)

Married, started using Married name. (on all documents forward)

Once GC was in hand (or EAD, but ours came within days of each other), went to SSA, changed SSC to Married name. (they wanted to see the GC and marriage license)

No issues so far. (drivers license, bank accounts, etc are in her married name)

You may want to check with your states name change laws, but Ohio was as simple as this.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

AGAIN hon, the marriage license is proof of her name change... whether it was done before or after the wedding, it doesnt matter... you do not need the EAD or anything else besides the marriage license to change her name on accounts or State ID... THE MARRIAGE LISENCE ALLOWS FOR OFFICIAL NAME CHANGE ON GOVERNMENT ISSUED DOCUMENTS... you guys are ok- dont complicate the situation

But if you want to wait then that is your choice- just letting you know u dont have to wait to get her married name on all government documents
