A petitioner can be granted a fee waiver for an I-129F? How on earth can this be? If a petitioner has to prove financial self-sufficiency at the interview to show the beneficiary won't become a public charge, how can a petitioner support a beneficiary if they can't afford the $455 petition fee?

A petitioner could, for example, be receiving SSI or SSDI, in which they might qualify for a fee waiver, yet still meet 125% of the minimum poverty guidelines, or the beneficiary's consulate may consider the petitioner's position and allow self-sponsorship of the beneficiary. I think.

Very interesting... I never knew that a fee waiver was available due to the fact that the petitioner's ability to support the petitioner was scrutinized at the interview stage. I would think a petitioner's inability to pay $455 would disqualify them from assuming the financial sponsorship for a beneficiary (and/or her children).

According to my understanding of 8 CFR, section 103.7, the I-129F is not eligible for a fee waiver, though it IS fee exempt when filed in conjunction with an I-130 (i.e., a K3 petition).

This is from section (c )(5) of 8 CFR, 103.7:

(5) No fee relating to any application, petition, appeal, motion or request made to U.S. Citizenship and Immigration Services may be waived under paragraph (c )(1) of this section except for the following: (Revised effective 1/12/09; 73 FR 75540 ) . (Added effective 7/30/2007; 72 FR 29851 )

(i) Biometrics; Form I-90; Form I-129CW; Form I-751; Form I-765; Form I-817; I-929; Form N-300; Form N-336; Form N-400; Form N-470; Form N-565; Form N-600; Form N-600K; and Form I-290B and motions filed with U.S. Citizenship and Immigration Services relating to the specified forms in this paragraph (c ); and (Revised effective 11/27/09; 74 FR 55094 )

(ii) Only in the case of an alien in lawful nonimmigrant status under sections 101(a)(15)(T) or (U) of the Act; an applicant under section 209(b) of the Act; an approved VAWA self-petitioner; or an alien to whom section 212(a)(4) of the Act does not apply with respect to adjustment of status: Form I-485 and Form I-601; and

(iii) Form I-192 and Form I-193 (only in the case of an alien applying for lawful nonimmigrant status under sections 101(a)(15)(T) or (U) ).

Unless I'm missing something, I don't see how a fee waiver for an I-129F K1 petition could be approved.

ALAN thats why they have a sponsor like i do i am married to a pinay and we have 2 sons my sister brought me back to the usa after i had a major heart attack and i brought my 2 sons now im trying to get my wife here and i will be filing for a fee waiver for the i-130 but my sister has taken on the responsibility of my wifes financial garrentee
