OCT 2003 = VISA ISSUED, ARRIVED IN USA, MARRIED.

SEPT 2004 = SEPARATED (SHE LEFT ME TO CALIFORNIA)

FEB 2005 = FILED FOR DIVORCE

JAN 2006 = DIVORCE DECREE

Met my new fiancee in her native country in Nov 2005. Now want to file another K1. Is there going to be a problem? Please, need some good advice..Please help....all advices will be appreciated

It will appear into the immigration records that you had petitioned a K1 visa before. However, you are not precluded of filing another petition provided that you can show an evidence that the previous one has been terminated.

yes, my previous marriage is terminted. I have my divorce decree Jan 2006. Also, I had sent all my approval notice (NOA2) and other documents back to USCIS in April 2005 with a letter from me to notify the immigration that my ex-wife had left me, and I filed for divorced. Take almost a year to get divorce.

now I am not attaching to my ex-wife. It's over between me and my ex-wife.

Hi Billy,

It seems from what you wrote that you did everything correctly and that you are divorce. Make sure to document everything in your new I-129F package and you should be alright unless there is something that you have not stated i.e. that you got arrest for domestic violence or something to that nature against your x-wife. But if you did nothing wrong you should be alright.

No, I have done nothing wrong. Never arrested. No domestic violence. Yes, she gained her 2 yrs conditional green card. AOS in DEC 2003. I supported her, took her to school to learn English which she did not want to learn. I worked alone to support her. I bought health insurance for her. Gave her credit card to go shopping with friends, added her name to my bank account. wanted to have driver licence which she didn't want to read the book. She does not want to work which I had to complaint about it. All I need was want her to have driver license so she can go places because sometime I didn't have time to take her places. I guess she want to stay with relatives in CA, and I can't stop her from leaving because if I did stop her..that mean I was holding her against her will. Because I don't want to get arrested about holding someone against her will. I just want to do the right thing. I guess things didn't work out between us.

Well, I am a USC. I met my new fiancee in NOV 2005. We spent 21 days together. we went places. My new fiancee is from Thailand. we talk everyday on the phone, yahoo, and msn. I met through a friend. Then we started to talk on the phone and see each other on webcam. I spoke with her 4 or 5 months before meeting each each other face to face. we have many things in common. I had SINSORT in Thailand. SINSORT meaning the money I have to give to her parent to get marry. I hope this is enough info about us.

That's what I figured.

I seem to remember the calculation for figuring household size included others you may have sponsored and are still responsible for.

It's not enough. There's nothing in what you have written thus far to indicate that there might be a problem, but that doesn't preclude a problem due to something that may exist but you have not mentioned. Remember also, sometimes problems can arise where none should exist due to errors on the part of the USCIS or the consulate.
