IRS' W7: Should I file ?

don't file. make a lot of trouble

CR1 timeline:

11/2008: submit I130

11/15/2008: case sent to CSC

06/02/2009: uscis approval

08/05/2009: interview-get blue slip request timeline

08/25/2009: submit timeline - get denial blue slip

You should only file it if you actually need a ITIN number for your spouse/child for tax purposes.

a W-7 is useful if you have a foreign spouse, living overseas.

I just finished reading yer prior posts -

I can't, for the life of me, find where you MARRIED someone.

IMO, a W-7 won't apply to you, you not have a SPOUSE.

Is there a benefit for filing this form w/ the IRS? I don't know anything about this one.

W7 is only for CR1, and IR1(SPOUSE), since you are K1 visa. Doesn't apply to you.

02-04-2009 : Visited my wife for 2 weeks. 02-22-2009 come back to US

11-03-2009 : Driving Test.

How about a K2 child?

When I applied for Linh's SSN the office lady said her daughter (10YO) is not eligible for SSN and I have to file W7.

K2's aren't eligible for an SSN until they have either an EAD or a green card. The only reason K1's are allowed to get an SSN before getting EAD or green card is because some states used to require an SSN in order to issue a marriage license. That would be an obvious catch 22 - can't get married without an SSN, and can't get an SSN until after marriage and green card. :blush:

I'm no tax law expert, but my understanding is any dependent you claim, including a K2 child, must have lived with you for at least half of the calendar year. So, presuming they came to the US just before the second half of the year began, you'd have 6 months in the tax year, plus 4 months in the following year before the tax filing deadline, to get them a green card and an SSN.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

The problem with the w-7 is that you CANNOT file eletronically. You have to file a paper copy. It clearly says chnces that getting a ITIN does not improve the chances in VISA application process. Although i feel come interveiw time the CO might consider that a good sign of evidence. I am going to file the w-7 i will be getting much more money back to help pay for my trip to HCM and Visa fees. SO it does have a few advantages but really slows down filing your tax return. I am going to submit the w-7 along with my AOS and past tax filings.

If the child lives in Vietnam with the mother (The child is USC and has SSN), we couldn't claim the child as dependent child?
