My US fiance is here in the UK with me until June as a visitor. Is it possible for us to apply for the K1 visa whilst she is here or does she have to be in the U.S to apply or would it be possible for someone to send it for us if we sent it to them first?

The US citizen files a petition. When it is approved, the foreign fiance will be invited to apply for a visa. The petition will be mailed to an address in the USA and can be mailed from anywhere as long as the petitioner's residence address listed is in the USA. Yes, you can send it to somebody else first or send it directly.

I'd just get married now and file for a CR-1 spousal visa if I were you. The CR-1 takes about the same amount of time and gives the beneficiary a green card and the right to work upon entry into the US.

I'm pretty sure you can begin the filing process while she's in the UK with you and finish up the process after she goes back, but someone else should be able to confirm that more definitively.

I'd just get married now and file for a CR-1 spousal visa if I were you. The CR-1 takes about the same amount of time and gives the beneficiary a green card and the right to work upon entry into the US.

I'm pretty sure you can begin the filing process while she's in the UK with you and finish up the process after she goes back, but someone else should be able to confirm that more definitively.

Sounds like you already know it isn't as simple as just doing it, to marry a foreigner in the UK. Visas are used to enter countries. I don't know whether approval to marry a foreigner can be obtained after arrival. Check with your local marriage authority.

I don't believe she needs to leave and come back on a special visa. A quick Google search yielded this page:

Which says "If you or your future husband, wife or civil partner are not nationals of the European Economic Area (EEA) or Switzerland, you can visit the United Kingdom together to get married or register a civil partnership as long as you intend to leave the country within six months."

Click around the rest of the links on there and you should be able to get most of the info you need. If she wanted to marry you and STAY in the UK, that would be more complex. But I THINK it's like the US in that you can come over, marry, and go back home with no problem. But do your due dilligence to find out all of the regulations and laws.

I don't know UK rules intimately so don't quote me on anything. I just know how to use Google most of the time. :thumbs:

I was too lazy to go hunting for the specifics. I'm a big fan of doing the Googling for oneself.

Sucks though for the OP. I'd check to see if there are other countries close by that you can pop over to and get married more easily.

You both can send it from the UK to the designated service center in the US (since your fiancee is only visiting, not living in the UK). or you could send the complete package to someone in the US to mail, but that would be adding an extra step. One thing, you need a check or money order in dollars to submit. The receipt notice will be sent to the home address, but it's not necessary for the USC to retrieve it. If you get an RFE, could someone send it to you?

Otherwise, yes, you could marry and file CR-1 after.

Your fiancee will file a petition. She can mail that from anywhere in the world. It is not a visa application. Upon petition approval YOU will apply for visa in the US consulate in your country.

YES, your fiancee can mail her petition request from anywhere. Hopefully she brought along all the documents she will need to do this.
