right im probably totally shooting in the dark here and got no hope but my question is this...........

I was married in the u.s in september to a man i have known for many years im now back in the uk( im a uk citizen) am i allowed to move to the us to live with my husband and daughter and file there or do we have to stay as man and wife living apart and send in the k3 etc which he has there waiting to send in???? i imagine the answer is we have to be apart just hoping there may be some way..sorry if im clinging to nothing x

You should never have left the USA... then the answer was simple....

your USC spouse must file a petition on your behalf.

Suggest two I-130 petitions - one for you, one for your child.

You should never have left the USA... then the answer was simple....

lol, didnt want to get deported for being an illegal immigrant!!!!! lol i just came back after another 4 weeks there i cant keep leaving and coming back to uk x so if i go back to u.s then with daughter can we apply there ????? and me stay?????

It is (or can be determined to be) against US immigration law to come here with the intent to remain on either a visitor's visa or Visa Waiver Program. The only allowable suggested path for you guys is to follow either the K-3 or CR-1 paths (CR-1 is advisable).
