Hello All,

I filed for AOS on Dec 21st and just received an RFE saying that I didn't provide a complete 'Form DS-2053, Medical Examination for Immigrant of Refugee Applicant' and that if I can't supply one that I need to complete an I-693 (Do another medical exam, and pay for it? or just the partial fillout for the vaccination portion?).

Isn't this the medical report that I handed in at the border on Nov 20th from the exam I had on Oct 21st that was in a sealed envelope that I wasn't allowed to open?

The only medical document that the I-485 instructions said I need to send in was the vaccination supplement (DS-3025?) from my exam which I did.

I'm waiting on email replies from the Vancouver consulate I obtained my K-1 visa from and the medical service that performed my exam to see if either of them have a copy of my medical report.

Also waiting on a call back from the local Congressman rep that I've already explained my case too.

Does anybody have any helpful advice or encouragement for me? Did they lose my medical report in transit between the POE and USCIS?

... it'll still work out in the end.. just wish it didn't have to be such a hassle :wacko: !

Well, at least they are clear in your RFE. They say they don't have (it's lost/burned/thrown out/stolen by little green men etc) your Visa medical, and you need to get a new one.

A congressional inquiry was successful at least once in getting them to look a little harder and it was "found".

You may decide to let the economic argument persuade you - you pay $200 for a new medical and resume processing, or you take 30-60 days (congressional inquiry time frame) to find things out -possibly they will find that yup, it was the little green men, and then you are 30-60 days longer in processing.

Could the new immigrant make more than $200. in those extra 30-60 days? Probably.

Well, at least they are clear in your RFE. They say they don't have (it's lost/burned/thrown out/stolen by little green men etc) your Visa medical, and you need to get a new one.

A congressional inquiry was successful at least once in getting them to look a little harder and it was "found".

You may decide to let the economic argument persuade you - you pay $200 for a new medical and resume processing, or you take 30-60 days (congressional inquiry time frame) to find things out -possibly they will find that yup, it was the little green men, and then you are 30-60 days longer in processing.

Could the new immigrant make more than $200. in those extra 30-60 days? Probably.

My father-in-laws mother has offered the help of a lawyer which I'm planning on resorting too if I don't hear anything from back from the Consulate/Medical provider emails.

Think that will give much more help? Or would it be more financially astute to just get another medical! ahhaa

Called all the local civil surgeons for pricing and found one that does the whole test (given you have the vaccines) for $150.

One said $300, another $600, and another $800-900 depending on what you need. Major Scammage!

The lady I talked to says USCIS losing medical stuff happens often.

So thanks for the advice, the $150 is worth it to bypass the immense hassle and frustration of the silliness of this process and keep the case rolling.

The lady I talked to says USCIS losing medical stuff happens often.

I was told this same thing at an Infopass appointment AND by the civil surgeon. She said that USCIS lost this one woman's medical THREE TIMES. The woman kept having to go back to the civil surgeon. I thought that was a bit extreme, but not unbelievable.

November 19, 2007 - Met

I got the RFE and it said there was no DS-3025, which I did send to them. It also said there was missing all other medical related documents too and asked for the I-693 and gave me a deadline of January 14th to send it or the whole thing would be rejected. We just did the whole exam and paperwork again and sent it and POW just got the "Welcome to the United States" letter yesterday.

And so I got the medical exam done a second time ... $150...

Today the congressman rep calls me saying that at the National Benefits Center they are saying all my medical is in order and I'm no longer required to send in medical evidence.. sigh.. can't wait for this to be alllllll over.
