1-08-18- rec'd hard copy NOA1 - I797,   7-02-18- I-130 petition for Mom approved- YAY!

08-23-18: Received an email from NVC with the case number MNL..Also paid the fees (AOS & IV)

10/16/18- Submitted all docs via CEAC, 10/25/18- Received an email stating " Case Completed/Documetary Qualified"

11/9/18: Received an email from NVC stating interview date,12/3/18: INTERVIEW DATE

What do you mean by they told me wrong? We called today again just to make sure and ask if we can travel outside the country and after speaking to 2 CS reps and 1 supervisor we were told that I'm eligible to citizenship 90 days before my 3rd wedding anniversary (that puts me at the beginning of October this year)... The only thing that can affect my citizenship process is if I'm outside of the country longer than 6 months (we're only going overseas for 1 week) and after stating that they mentioned twice that I have nothing to worry about...

You can either believe what an operator answering phones tells you or what the immigration laws say and the experience of many VJ members.

If you can become a USC after 3 yrs of marriage to a USC then why bother with all of the LPR stuff?

Remember that the USCIS operators are not immigration specialists. If you apply for USC before you've been an LPR for 3 years AND married to the same USC for 3 years then you will get denied or have the application packet returned to you.

You can hop over to the citizenship forum for info on citizenship.

But for a quick answer, see the N-400, which is the form you'll be filling out to become a citizen.

In Part 2 you have to check a box for eligibility. You'll most likely be checking box B: It says "I have been a lawful permanent resident of the United States for at least three years, and I have been married to and living with the same U.S. Citizen for the last three years, and my spouse has been a U.S. Citizen for the last three years".

When you can honestly check that box (or one of the other boxes in part 2), you'll be eligible for citizenship.

Keep in mind that the term "lawful permanent resident of the United States" is interpreted in immigration context as meaning someone with green card status. And your green card has a "resident since" date that you can use to determine when you will have completed three years as a lawful permanent resident.

See the M-476 for more details on eligibility. In particular, the box at the bottom of page 22 tells how you can send the paperwork in 90 days before you have completed three years with your green card, assuming you meet all the other requirements.

OP congrats on the GC but you're wrong about citizenship.

Read the M-476 manual for naturalization and it will be a lot more clear to you that you don't qualify until residence since date on your GC plus 3 years minus 90 days to apply.

May want to update your signature as well on this.
