I wanted to know if this is correct.

We went to the SSN office, and they told me that we have to get the AOS done first before they can issue a SSN number. This was because we got married, so the K1 was no longer in effect. If we had applied BEFORE we got married, then it would be have ok. Is this correct?

I have seen posts where people had this happen - go through this thread - it may help you yet!

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

No not correct... marriage does not alter/change/nullify your arrival (K-1) status. As long as you have a minimum of 14 days left before the I-94 expires you are still eligible to apply. However, you are not alone and others have had this issue.

I just called them on the phone and they said that she is NO LONGER A FIANCEE, so that her status is no longer a K1, so she is not eligible until her status changes.

We do have more than 14 days left. Almost 2 months left.

Is there something that I can print out to take and show them?

You might want to check out this internal e-mail from SSA in this link http://www.visajourney.com/forums/index.ph...page=otherforms called SSN K-1 Authorization. I brought this along with the RM 00203.500 in case they still insisted on not allowing Cory to apply. Thank God we had no problem and we applied today. They will have her number ready tomorrow although the card will take longer to come in the mail.

January 21, 2010 - Submitted AOS

January 25, 2010 - Cory received her SSN

March 9, 2010 - Received appointment for biometrics - will be on March 18

March 18, 2010 - Biometrics done

March 19, 2010 - Touches on I-485 and I-765

March 25, 2010 - Advance Parole approved..received on April 1 in the mail

March 29, 2010 - I-485 notice date, received on April 4, 2010

May 3, 2010 - EAD approved

May 5, 2010 - Date interview....approved

Right, I read that and she said it states FIANCEE. She is not my FIANCEE any longer. I will try again and point out to them that she has a VALID I-94. Fiancee should have nothing to do with it. It is the I-94 that they should look at and that is valid until March 15th.

Hi,

I applied for my SSN after I got married. The lady working at the SS office told me that I couldn't get it because my I-94 did not have 90 days left until it expired. I started trying to explain to her about the K-1. She wasn't listening but she said she would enter my info in her computer and see what happens. It was approved, which was a surprise to the SS lady.

Go back to the SS office and regardless of what nonsense they tell you, make sure you get them to enter your wife's details in the system. Those people working there don't know anything about K-1 visas.

I brought some print outs with me about K-1 and getting SSN, but I never had to show them.

Once approved, you can usually go back and get the number the next day if you don't want to wait til the card comes in the mail.

I think what caused the issue was the fact she asked if we had been married. We said yes and that was is issue. She said she (my wife) is no longer a Fiancee so her status changed. I will tell them she has a VALID I-94, regardless of the fact we are married. He status does NOT change until she is approved the AOS. I will try again and see what happens.

Yes, we went just a week after we got married to get Nigel's ss# we did the k1 as well, and they had to look up the rules on k1's and they didnt give us any problems after that. We had that lovely paper to show them in case but they looked it up themselves and we compared notes..lol...we SHOWED them! HAHAHAHAHAHA......God I love visa journey...
