I am a US citizen and applied for AOS for my mother and father. They just got a approval notice for their I-485 but my Mother got a conditional residence valid for 2 years while my father got a permanent residence for 10 years. Is this even possible? I thought conditional residence was for PR by marriage and investment. I am planning on filing a I-90 but wanted to check with the community on their thoughts.

My mother did overstay by 30 days before I applied for the AOS.

Best bet is to make an INFOPASS with USCIS and inquire - they may of made a mistake.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Already did Infopass today. The Officer said file a I-90 but he never definately said what the rules were for conditional residency. I believe my only option is to file a I-90.

That would be stupid and a waste of money.
