God, that's awful! Now, all the Brazilians have to pay for the court's wrong decision? I just hope this kid gets back to his dad ASAP! What a shame

That is not an objective test as to whether the father should be granted custody. The boy was 4 when his mother ran to Brazil with him then filed for divorce.

I'm thinking what is in the best interest of the child, he grew up in Brazil and has a family there he's used to, a culture he's used to, a language he's used to. Yes, it's his biological father, and yes, he's got rights and strong ones since he's the biological one, but I think the controversy with the brazilian judges right now is the kid. Is he better off with his mother's family in an environment he's used to or with his biological father?

Ultimately, the rights of the father supercede those of the grandparents and aunts and uncles. The fact that the Brazilian court system has taken 5 years to decide on this court makes matters even worse.

yes, if he was old enough to make that decision - in most states it's around 13 years old or so.

short version - she allegedly went with the kid to brazil to visit, but filed for divorce while there and never returned. she later remarried and after that passed away, the stepfather has custody of the kid. father has been in court battles for 5 years over it.
