Hi! Thanks to all in advance who take teh time to read my question and give me any feedback. Please be considerate because as many of you know this process is very daunting and frustrating, and sometimes scary. All anxiety aside, here is my situation. My boyfriend is Brazilian and our I-129 F petition was approved in March 09. Due to problems with his family in Brazil we did not take action and now we are ready. We were dealing with the Spanish madrid consulate because he was living in spain, now he is moving back to brazil. Can we contact the Madrid consulate to see if our approved petition is still an open case? and if so would it be a problem with transferring the case to the salvador, bahia american consulate in brazil? I know that consualtes don't like any problems. The last thing I want to do is negatively affect our visa process. I know also that the petition expires in 4 months but I have read that the case will become abandoned but remain open for a year?

Would it be better to reapply for the 1-129f all over again?

More or less we are curious to see if our petition case is still open in Madrid, and if so if we could move it to Brazil. has anyone had any experience with an expired petition or with switching consulates?

9/13/10- Civil Ceremony, Married :) (our real wedding comes later)

10/7/10-NOA 1

11/26/10- Biometrics appointment

12/10/10- AOS transferred from MSC to CSC

12/17/10- Card/Production EAD ordered!

12/22/10- Ead recieved

1/6/11- FL driver's license

Most likely the petition has expired and you must begin again. All the petitions have a 4 month period of validity which is normally extended automatically by the embassy.......but only if you continue to pursue the process. I am assuming you/he received the packet 3 and never returned it.

Call the embassy to determine the status but be prepared to have to start over again.

If you have your letter from the NVC (posted to the US petitioner) it will have a case number on it. Use that case number to call DOS and ask them about the status of your case. They should be able to see if it is open/closed/abandoned/whatever.

You might query the DOS representative if they can get the case transferred - if not, then work directly with the consulate.

Hi, all the visas for immigrantes (including k1) is done by the Rio de Janeiro consulate.

He will not be able to have his interview in Bahia (also, they don't have American consulates there), he'll need to fly down to RJ.

About the Madrid consulate, I dont think they have nothing to do about it. You should call the USCIS and ask them what's your case status.

So he moved back to Brazil!! well I really hope things to work out there... Im still here in Spain, illegally, in our CR-1 process. I found someone who was living here in madrid illegal too, and he applied for a K1 visa, and he got it! now he lives with his wife in the US, and of course he was not able to get a police certificate! Please let us know how things r working out for u!
