i had my I485 denied and i received a letter from uscis, they asked me to leave USA in 30 days , they told me that they don't initiate any removal procedues against me at this time , but if i don't leave USA in 30 days i will be under removal procedures. i want you to know that i came here under k1 visa in january 29th 2009 and married my fiancee in march 15th i sent my AOS in May 25th i received the denial in november 19th , but the date in the letter is 17th.so if i leave usa in 30 days will i have a prob to use I130 to join my wife? did i overstay? i'm confuesed.hel please.thank you.

Does your wife want you to stay? Why were you denied? Does she want a divorce?

we had probs like every couples and she acted under anger, she withdrawn the affidavit of support, then they denied my I485. is there any solution? can we contact the senator or the congress man

Obvious. I don't see any solution but to go back home and re-initiate the process. but then again, I am not an expert.

Contact an immigration attorney.

If you have been asked to leave, you should leave within the stipulated time.

Wait, didn't your wife pull the I-864 twice?

I say you better leave per the instructions from USCIS - you certainly don't want to set yourself up for failure for not obeying an order. From your home country start again with the new application.

You did not overstay, but if you ever want to come back here on an I 130 (assuming your wife has a change of heart), you'll want to follow their instructions and leave the country by the date in which they said you must leave.

TWICE (that's a lot of anger)... why would you want to be with somebody who is that unstable?
