I 864 When You are Disabled and Your Income Won't Count

Hi I'm Rae and I'm new here as of today.

My husband is in Ghana........and we are getting ready to start all our paper work ......My biggest fear is the I 864. I'm disabled and only receive SSI income......My Dad lives with me and has pension and Social Security. Does anyone know how that will affect our chances of bringing my husband to the States......

And If I don't use my Dad's income can I use another family member who does not live with me as a sponsor to get my husband to the states.

Yes, I would definetly use a co-sponsor (other than your father)... They do not have to be a family member... But have them fill out an 864, send in their income proof (tax returns, employment letter, pay stubs) and proof of their citizenship/LPR and you should be fine...

Yes, I would definetly use a co-sponsor (other than your father)... They do not have to be a family member... But have them fill out an 864, send in their income proof (tax returns, employment letter, pay stubs) and proof of their citizenship/LPR and you should be fine...

Thank You So Much it worries me alot......... My Aunt has only her and her husband on their tax return and she would be willing to do it for me......Her income is about $55,000 I hope that will be enough income to cover his sponsorship.....

I agree, but wanted to add a comment/question. Aren't social security retirement benefits and pensions considered as income? Not SSI, which is a "means tested benefit", but Social Security Retirement - because it's a system you pay into, where SSI is not. So her father's income would count as income, although hers would not. But what about Social Security Disability payments? Those are not the same as Supplemental Security Income (for people who have not worked enough to have earned SSDI).

What's everyone's take on these sources of income?

Although SSD benefits technically should be counted, since they are a seperate line item on the 1040 (SS benefits) and they are not always considered under taxable income if you earn in total under a certain amount, it depends on the adjucater of the AOS as to whether it will trigger a flag. Should it count, yes, but the embassy and NVC sometimes do not look favorably and ask for a co-sponsor anyways...

So to be safe, I would use the co-sponsor... 55k is definetly enough to qualify based on the 3 dependents (the anut, husband and your husband)...

Retirement income is specifically mentioned (pg 7) in the I-864 instructions. Social Security income would be in the gross total income amount that is considered when evaluating the I-864.

:time: Seriously people come on. Be careful darling and make sure you are not being taking for a ride. It's one thing that you sponsor him but know you are getting family members involved. Just my opinion please don't take it personal.

hey girl ur situation is the same as mine i also recieve ssi
